For years, the federal government didn’t do as much as it could’ve to diminish the flow of illegal immigrants across the U.S.’s borders.

There was the infamous catch-and-release program wherein illegal non-Mexican immigrants caught by the Border Patrol were released from custody after being given a date to appear for deportation proceedings. That was because authorities didn’t have enough detention space to hold them.

Of course, many never did reappear, and who could blame them?

Catch-and-release came under so much political pressure from proponents of stronger border enforcement that the federal government was forced to promise it would curtail the procedure completely by Sept. 30, the end of the federal government’s fiscal year.

But it actually was able to end catch-and-release earlier. Homeland Security Secretary Michael Chertoff today held a press conference to announce that the catch-and-release program had been completely transformed into catch-and-remove, weeks earlier than the stated goal.

“I am pleased to say not only did we meet that, but we exceeded that deadline,” Chertoff said at the press conference. “As of the last several weeks, we have essentially been at 100 percent catch-and-remove in our southern and northern border.”

The end of catch-and-release has had a follow-on benefit, according to Chertoff—deterrence. It appears some would-be border crossers are choosing not to cross rather than risk being caught, placed in detention, then deported, he said.

“We now see a real marked decrease in the number of non-Mexicans coming across the border as measured by our apprehensions,” Chertoff said. “And this is proof positive of the deterrent effect of this new catch-and-remove policy.”

Well maybe. A reporter at the press conference asked if it wasn't possible that illegal border crossers, who in the past had easily given up, knowing they’d eventually be released on their own recognizance now just worked harder to avoid capture.

Chertoff acknowledged that possibility, but said he was encouraged that the number of Mexican illegal border crossers had fallen too. That suggested to him that efforts to make the border less porous were working.

CHERTOFF: I certainly think it is true that under the old system there were some OTMs (other than Mexicans) who volunteered to be caught because they knew they'd be released, and that's clearly been eliminated.

But that's where I think if you look at the numbers of Mexicans as well it's very suggestive because that number has gone down as well. And I think that the reasonable inference if you look at the total pattern of OTMs and non-Mexicans is that the measures we're putting into effect have started to have bite and it is affecting behavior in bringing deterrence.

But one of the things I wanted to caution about was criminals who have made a livelihood off this are not going to walk away from the business, so I expect that we will see efforts to try to end-run us or push back on us.

And this is not meant to say job is done or even substantially done. It's meant to say we're seeing progress. We're beginning to be able to test that what we're doing is working. But this is a time to redouble our effort, not to slacken up.

In a similar vein, another reporter said to Chertoff that some people attribute the drop in apprehensions to illegal entrants making the crossing across more difficult parts of the border.

Chertoff didn’t see this as necessarily a bad thing.

CHERTOFF: Yeah. First of all, I mean, to the extent people are being pushed to areas that are more remote, that in itself is good because those are harder to cross, fewer people want to cross them, so that in itself is a positive development.

There was some suspicion at the press conference that Chertoff was making the announcement in an effort to appeal to immigration hardliners before the November election.

No, said Chertoff. This was more about letting Americans know that the additional resources the administration had asked for to secure the border was being put to effective use.

The press conference also gave Chertoff a chance to again make a plea as he has in the past for Congress to change what he views as an antiquated policy which prevents Salvadorans from being returned to the El Salvador.

A court order 20 years ago prevented such illegal immigrants from being immediately returned to that nation because of the civil war then raging there. Though the civil war ended in 1992, federal immigration authorities still must operate under the same rules.

CHERTOFF: We are currently detaining all El Salvadorians, or virtually all of them, because we now have enough beds, and we've had enough deterrent effect to significantly reduce the total number of non- Mexicans.

But we're still hamstrung in our ability to remove those El Salvadorians on an expeditious basis. It still takes us much more time to remove them because of these legal restrictions. And that means that we are in a situation where it will be very difficult to sustain what we have achieved unless Congress acts to change the law that is tying our hands.

And I'm going to be perfectly clear about this. The civil war in El Salvador is over. The reason for these restrictions has long disappeared. It would be as if we were still keeping to, in effect, World War II rules that had long since passed their necessity.

So once again, I appeal to Congress. Make this change in the law. Give us the ability to dissolve this court order that is tying our hands, and we will commit to continue to sustain 100 percent catch-and-remove.

Terry...This is one issue I do disagree with the democrats position. At least give me credit for having my own thoughts and that I don't follow them blinding. However...If the Republicans truley wanted to push this through...They have complete power to do so. Could it be there are votes involved in this and that is why we have not seen any resolve?

That is bogus. Show us proof that illegial aliens are voting. I'll give you the benefit of doubt and presume you're referring to that lightweight candidate in San Diego who said in a speech that it didn't matter if you were illegal, you could still help out w/ the campaign.

And your union buddies want to get them jobs so they can extract dues for them. Also, all the north shore libs want the illegals here so they have maid service and well trimmed lawns.

I'll make no apologies for the administration and their lack of prosecuting business people that want the illegal aliens for cheap labor, they should be caught and prosecuted as the law requires.

I forgot all the pandering that was being done in this illegal immigration marches that was being done by "da mayor" and all his democratic congressman. Pandering, invented and perfected by the dems.

Illegal immigration is a problem that needs to be addressed. You are always so concerned about the minimum wage, tighten the labor pool and ewages will rise whether there is a law passed or not


A enhanced Social Security Card containing biometric data unique to the cardholder, such as fingerprint and iris print, would go a long way
in helping to solve the flow of illegal immigrants into the country.
We could easily identify who belongs here during the process of issuing these cards, through birth records and other historical documents unique to each individual.
Employers would be required to scan the fingerprint or iris print of every employee or job applicant, and transmit it to the S.S.A for verification.
No match - no job.
Sooner rather than later, the incentive for illegal immigration, jobs, would be removed from the equation.
No one would come if they could not find work here, and you can not find work without proving that you are here legally.
This information would also prove to be invaluable
in the fight to eliminate welfare and Social Security fraud.
But no, Congress and the administration will continue their attempts to control illegal immigration with worthless tactics like fence building, border patrols, voluntary deportations and such.


No matter what form of identity you use, someone will figure out how to get around it. Plus, didn't the FBI or CIA just waste billions and years on a system that can't work to track criminals?


...the "Tamperproof Identification Card" will be as effective as the "Unsinkable Ship"...

You make interesting points but fail to grasp the purpose of an I.D card.
Loch - The purpose of such a card is not to track individuals, but to clearly identify who is here legally and has the right to hold a job.
BZ - Fences are cut more easily than decoding the encryption on an identity card.
This should not be the only method used to address
the illegal immigration problem.
The underlying causes of migration to the U.S needs to be better understood as well. Economic, social and political forces in other countries should be
examined and an effort must be made to influence these forces to any extent within our capabilities.
