With the prosecution having rested its case in the Lewis "Scooter" Libby trial yesterday and his lawyers scheduled to start presenting the defense's case on Monday, it's a good time to ask how much damage control his lawyers have to do. The answer: a lot.
In fact, it looks like Scooter is in a very deep pothole that may be too large for his lawyers to extricate him.
Libby, as most Washington watchers know, is the former chief of staff to Vice President Cheney. Libby allegedly committed perjury before a federal grand jury when he testified about how he learned the wife of a Bush Administration and Iraq War critic worked for the Central Intelligence Agency.
Libby told the grand jury it was NBC News's Tim Russert, host of the Meet the Press program, who told him about Valerie Plame, the wife of Joseph Wilson.
Wilson was one of the Bush Administration's most high-profile critics after the start of the Iraq War, accusing the Bush Administration of misusing intelligence to launch the war.
But Russert testified that was untrue. And a string of other witnesses, including former New York Times journalist Judith Miller, said it was Libby who told them Wilson's wife was at the CIA.
The only strategy that appears left to the defense is to convince the jury that Libby had faulty recall because of his superheated schedule as a top White House official.
But that's going to be a hard sell.
The trial so far has reinforced that Wilson was highly important to the White House which was starting to feel under siege in the spring of 2003 after the invasion when no signs of an ongoing weapons-of-mass-destruction program turned up in Iraq.
Wilson had become something of the White House's Moby Dick, an obsession, after he said publicly it was Cheney's office, through the CIA, that had sent him on a fact-finding mission to Niger to learn if Saddam Hussein was trying to secure uranium for a nuclear program.
The answer, Wilson said, was no. But the White House wouldn't take no for an answer, according to Wilson.
Cheney and Libby were outraged because, as they saw it, Wilson was telling tales, the same thing he accused them of.
They hadn't sent him to Africa. It was someone in the CIA, his wife. At least that's the narrative they wanted people to believe. They had to get their side out. That's where the conversations with Washington reporters came in.
This passage from today's Los Angeles Times story on the case captures the challenge facing Libby's defense team created by the pile-driver prosecution by U.S. Attorney Patrick Fitzgerald.
Fitzgerald has "methodically constructed a wall of witnesses who all testified to what a significant issue Plame and her husband were," said Henry E. Hockeimer Jr., a Philadelphia lawyer and former federal prosecutor. "It's going to be hard for the jury to believe Libby simply was too busy at the time of his grand jury testimony to remember his conversations."
The biggest day in the remaining trial, at least for journalists, will be if the defense calls Cheney to the witness stand. Maybe Cheney will be able to work the jury enough to win sympathy for Libby. That would be something to see.
Not to jump too far ahead of ourselves, but if Libby were to be convicted, and the conviction stood up after the expected appeal, what would the chances be of a pardon from President Bush?
I've asked that question of other Washington types and they all say a pardon would be unlikely because it might send the message that perjury before a grand jury was forgivable.
Given that former President Bill Clinton was impeached by a Republican Congress for perjury in a legal proceeding arising out of his affair with Monica Lewinsky, a Bush pardon of Libby would, at the very least, send quite the mixed message.
A Libby pardon could also become a political weapon for Democrats during the 2008 campaign. Even if Bush didn't issue one before the general election, he might be forced to promise that he wouldn't afterwards in order to keep if from being an issue.
So the smart money says there won't be a pardon if there's a conviction, which there isn't. At least, not yet.

Scenario: December 2008: A Democrat is now President-elect. GW Bush is scheduled to leave office in January. Does anyone honestly believe that he'd keep a promise NOT to pardon Libby that he made during the campaign?

Libby is going down, that's clear. But Mr. James, isn't he bound to Bush and Cheney? What about Cheney's hand-written note naming the Pres. himself? They can't just deny they had any knowledge of all of this, it's already on paper marked as evidence.
Won't he pull them down with him? So much evidence has been uncovered in this trial that it wouldn't be hard to make a conspiracy to commit treason case against both Bush and Cheney.

The smart money would be wrong. Bush doesn't give a damn what anyone thinks, and he doesn't care how his actions affect his party. One of his last acts as president would be to pardon Libby if he is convicted. I would bet money on it.

Libby is in deep do do. Peter has put up on his web site every thing to told to FBI and others great read. Libby's lies have cought up to him and now the VP could get het very hard by hearings and may even have to leave office

GW Bush and Dick C. knew there was no WMD's in Iraq. There was too much money to pass up for Republicans by starting a "war" in Iraq. By the way, Congress declares war, not the president. We invaded Iraq and now we occupy it. Does anyone remember GB's dad was head of CIA? Good thing he didn't have to go to Vietnam.

If Libby is found to have committed perjury, he should be punished appropriately for it.
That is the only issue to discuss here.

George W Bush is proven liar, who himself was rescued from the burden of his own criminal acts by the political power of his daddy, so there is no doubt that he, like his father G HW Bush will issue 11th hour pardons to any his criminal republican comrades who happen to "get brought to justice". He and his administation have been nothing but comtemptible and repugnant to the majority of honest moral citizens of the USA.

Given that it now clearly appears that (1) it was Cheney's office that dummied up the Niger uranium falsehood (raising the spectre of Iraq's alleged WMDs), and (2) Cheney's office (Feith) who seems to have bent intelligence inappropriately on the issue of Iraq-al Queda ties. Doesn't it seems clear to many that it was Cheney's office that ginned up the 2 major pre-war arguments for attacking Iraq? The President initiated a war under false pretenses. It has costed thousands of American lives (not to mention Iraqi lives, and will cost America over $1 TRILLION dollars when all is said and done. Why aren't the American people (especially the military families of more than 3100 dead service people) up in arms about the completely fabricated primary causis belli for the war?

I liked your take on the trial. But you say Clinton was impeached for perjury ... shouldn't that be alleged perjury? He was acquitted after all, and never proven to have lied under oath. If Libby is convicted, the cases will not be parallel.

Huh? If there's one thing I learned from the leak case it's that Bush doesn't need to say a word about anything if he doesn't want to - no matter how politically absurd his silence.

I think Bush will pardon Libby. Sooner, rather than later (if that is possible). Bush is nothing if not stubborn and loyal - he seems to value those qualities rather excessively. To pardon a dedicated public servant (and spare him the indignities of lengthly appeals) is an action right out of the GWB playbook.
The handy thing is, the sooner Scooter (heh) is reprieved, the less likely he'll flip! Cheney will take the truth to his grave, and the Bush legacy will be spared further tarnish (on this issue, that is).

How's that? It'd be the usual justice-for-some plan that the federal government under the Clinton and Bush regime has followed. It's not like Bush put Sandy Berger in the electric chair. I bet they're BOTH pardoned.

Note well : A President can arguably not pardon cases related to his impeachment. Article II, Section 2, clause 1
The President shall ... have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.

I didn't see anybody on the pardon list that was responsible for the incredible death and destruction that have been visited on the IRAQI and AMERICAN people as a result of massive incompetence and hand-crafted intel. The biggest difference to me is that when Bill Clinton was President Only HE was getting the BJ, But, now Bush is president we're all getting screwed. That's democracy! Other than the remark about Cheney and Libby being outraged, none of this is true. This not mere semantic deconstruction--it is a biography of spin, a manual to White House myth creation.
A simple review of the record of Wilson's "public" comments reveals that he never said that Cheney's office "sent him to Africa". He has always maintained that the Vice President asked the CIA to investigate the issue and the CIA did just that by selecting Wilson to go to Africa. One has to be either illiterate or a Republican political operative to believe that such a statement means the same as "Cheney sent me to Africa".
The flip side of this myth is equally inventive. Witness accounts of the process of Wilson's selection clearly point out that his wife was not employed by the unit that was responsible for Wilson's trip. Her involvement in the matter was limited to two actions: after Wilson was nominated, Plame was asked to confirm his credentials, and, at the official briefing on the planned trip, Plame was asked by her superiors to introduce Wilson. Neither of these actions constitutes "sending" Wilson to Africa.
The probability that the White House did not know this is zero. Wilson's credentials for the position are unquestionable--he is a high-ranking diplomat with experience and connections in both parts of the world (Niger and Iraq), and a fluent speaker of French. His findings had been confirmed and enhanced by reports from other investigators both before and after Wilson's trip. Yet, Cheney's office chose to dismiss the investigation as a "junket" because the findings undermined the credibility of their assertions.
Cheney and Libby were not presenting "their side of the story". They fabricated disinformation to protect their interests. We may never know if they technically broke the law while doing so--we may have our opinions, but these are based on incomplete and contradictory information. But Libby was caught in a lie--not about Joseph Wilson, but about his own actions. This is why he is on trial and this is why he finds himself in a "deep pothole".

Thanks for the list of Clinton's pardons, Tim. I can't to this day understand why he gave those pardons, though I'm sure it was to fulfill promises made in exchange for campaign support. I think the Presidential pardons are a mockery to the justice system and should be abolished. Not one President has had the balls to pardon Leonard Peltier, a case that does truly deserve study.
Too bad the Libby trial hasn't gotten the public interest as it should, but then it's just not as easy to understand as a stained blue dress, is it? Clinton's trial highlighted the stupidity level of this country for the whole world to see.

Regarding Pardons -
The scariest scenario I've heard is: (1) Prior to the swearing in of the new President in 2009 Bush pardons Cheney and everybody else who may have committed crimes in his administration vis-a-vis the war, torture, eavesdropping, ect., (2) Bush resigns as President, Cheney takes his place, (3) Cheney pardons Bush of anything he may have done during his presidency in violation of the law. Everybody is off scott free - except, of course for those who've died in Iraq because of the cynical mendacity of Cheney and Co. (as Bush truly has just been along for the ride these last 6 plus years . . . . )

For the list of pardoned people to mean anything, there has to be context. Most of the people pardoned were convicted many years ago, have served their sentences and turned their lives around, and were not political cronies. They apply for pardons because of personal reasons, not because they are owed political debts.
In Libby's case and that of other cronies, the motivation is a little more suspect.

Tim ... Thanks for the reminder of Clinton's pardons. Those who forget history are condemned to repeat it. I have no doubt that Bush will pardon Libby after conviction. My only hope is that we can at least find a time to punish Bush's Republican associates at the polls as a result.
But on the topic of "not forgetting history" there is another way we might do that.
I'd really like to vote for a qualified woman for President. Nancy Pelosi seems to be doing a great job as Speaker, for example. But I have to agree that Clinton's pardons stink of textbook political payoffs after he thought he was beyond reach.
Ms. Clinton has so far been to be only too willing to sign any bargain with the devil necessary to grab power. Her refusal to confront her own voting record on Iraq is exhibit number one. If anyone can "reach" Mr. Clinton for the miscarriage of justice represented by his pardons, it's Ms. Clinton. It's reason enough for me to refuse to support her.

I think a better defense strategy would be to claim entrapment: Plame and her employer Brewster Jennings weren't secret in the first place. So there was no reason to investigate except to get Rove, Cheney, and Bush.
Defense lawyers should present evidence about public knowledge of Plame, Brewster Jennings, and their relationship.

I donj't know how much of the trial you have been watching. Maybe only the prosecutor's performance. From what I've been reading the "real show" has been when witness after witness has had to retract or correct their testimony. I think the Defense is doing an excellent job, and I expect to see a total acquittal. The prosecution has rested and there is, in my opinion, an awful lot of "reasonable doubt."

While there have been a couple of fabricators in recent years including the likes of Jayson Blair and Stephen Glass, it's not fair to lump all journalists under the same blanket.
Claiming that all journalists are novelists because of a couple people like Blair and Glass is like saying that all Congressmen are homosexual pedophiles because of Mark Foley.
Just because one bad apple can infiltrate an organization doesn't mean the whole tree must be tainted.

Whatever happened to one of the cornerstones of conservatives; You are responsible for your own actions?
Republicans held a majority accross the board for 6 years, & what do you have to show Americans for it?
Apperently, among Republicans, that ideal of responsibility no longer exists.

I think Casey's got it right. They'll pardon Libby immediately because they simply don't care if we think they're crooked. We know they are.
The list of Clinton pardons is impressive, but I heard he's not president anymore. Without more information, I don't know if those people really should have been pardoned or wether that was a Clinton fundraising tool similar to the Republican "legislation sale" we've had since 2000.

No one has been charged or convicted with "outting" Plame. Libby stands on trial for perjury - lying under oath. Same thing Martha Steward went to jail for (not SEC fraud). Clinton was brought up on impeach charges for perjury, not the act of what he did in the oval office. Ergo, if Libby is found guilty and goes to jail (high probability) he has NOTHING to due with the outting case and no tie (or deal) to convict Bush/Cheney.
Second. You may not like the war in Iraq, but is legal - both in the US and UN (resolution 1442 which allowed the use of force).
Third, US oil companies control about 13% of world oil. The US imports around 20% of its oil use. 80% of that comes from Venezuala (ergo, give up the blood for oil thing).
Fourth, there will be no impeachment of Bush/Cheney. Nor any "war crime" tribunals. Cry all you want - won't happen.
Fifth, I did vote for Bush (twice) and am very proud. And no, I don't plan to join the army. Same reason I don't want to be a baker. Harp and moan all you like. Call names. I'm pretty happy with things. By all the hate from the left out there, their lives must be pretty bad. Oh well.

I think it’s extremely comical how Bush and Cheney supporters continue to come to this administrations defense. This administration has been and in my opinion will continue to be a nightmare for the Republican Party and conservative views. They are doing more to damage the integrity of the Party than Nixon ever did. Pick up the Jan 22 issue of Newsweek some stats : 9 of 10 Iraqis (note Sunni and Shia not Kurd) see the US as an occupying force: 70% of elementary school kids are no longer attending classes; 2 million middle class citizens live out side Iraq.
Do you think this is the cradle of the next generation of Jihadist? The Republican Party and America will pay for this administrations failures, lies and economic blunders for years to come.

Did you mean 2006? My advice to you is finish high school before you debate. Secondly, the elections results did not distress me. The 2004-2006 congress did little to nothing and brought it on themselves. Change is also good and would like to see how Dems can make things better. Along the same reason I didn't vote for Topinka for IL gov. We WILL see either income taxes go up or sales taxes in the next 4 years due to Blago's mis-management. Why blame it on Topinka. Let the Dems falter and Repubs come save us all.
As I stated before - my life is better than 6 years ago. Lucky me. And if that "makes you sick", so be it.

UN resolution 1442 does not make the US invasion of Iraq legal. The resolution only mentions "serious consequences" and Frances threat to veto any action that called for violence renders 1442 esentially moot. The invasion and occupation of Iraq are illegal uses of force and attacks on an independent nation. We went after the Nazis for this behavior in Poland at the beginning of WW2.
We are in Iraq for the oil and Afganistan for the pipeline, our soldiers should be honored by all Americans, they should be cherrished and brought home safely, immediately.

I find the left wing hate repulsive. If we had taken Hitler out in 1939 people would be saying the same things as they say about going into Iraq today. The only mistake we made was trying to give democracy to a 14th century culture. Oh the good old days of the cold war. We should have gone in and crushed the barbarians, set up another brutal dictator who is favorable to U.S. and gone on to Iran and Syria. Of course, the usual left wing appeasment will lead to WW3 with a nuclear ending. And the liberals long term strategy of controlling the entire education system, the news media, and the entertainment media will insure that they will control for a generation until we learn our lessons the hard way. I bet Russert lied, I'm surprised they didn't call Chris Matthews, Dan Rather, and Jack Cafferty to testify against "Scooter". I hope W does pardon him.
