Congressional Democrats have threatened for months to subpoena former White House officials related to the Capitol Hill investigation of why several federal prosecutors were fired. Today the lawmakers are finally acting on their repeated warnings.

They issued a subpoena to the White House for e-mails related to the prosecutors' firings and they want them by June 28.

This from the letter over the signature of Rep. John Conyers (D-Mich) chair of the House Judiciary Committee.

We issue this subpoena with extreme reluctance, and only after making repeated attempts, as reflected in letters of March 9, March 22, March 28, and May 21, to secure voluntary cooperation from the White House in this matter. In response to a series of attempts to secure such cooperation, however, and a clear warning that we would have no choice but to utilize compulsory process if voluntary cooperation was not forthcoming, you have simply repeated the same unacceptable "take it or leave it" offer you made several months ago. Our Committee has made abundantly clear that we appreciate and respect the institutional prerogatives of the White House and that we remain ready and willing to resolve the issues on a cooperative basis. Unfortunately, we have not seen any indication of such willingness from the White House.

As recited in detail in previous letters, and as demonstrated again by documents produced just yesterday by the Justice Department, there can be no doubt that White House officials played a central role in originating, supervising, approving, and dealing with the aftermath of the plan to replace at least nine U.S. Attorneys since President Bush's re-election, a role that remains largely unexplored and inadequately understood. Many of these facts are recounted in previous letters from Senator Leahy and from me, on May 16 and 21, respectively.

To cite just a few examples, e-mails provided by the Department of Justice show that Karl Rove and Harriet Miers were involved from the very beginning in plans to remove U.S. Attorneys after President Bush's re-election, and that the Department official who compiled the lists of U.S. Attorneys to be fired, Kyle Sampson, was in frequent contact with White House officials on the subject. Yet after extensive review of Department documents and on-the-record interviews with a variety of senior current and former Department officials, no one at the Department seems to know who suggested putting most of the U.S. Attorneys on the list to be fired. One such U.S. Attorney, David Iglesias, appears to have been put on the firing list only after Karl Rove relayed complaints about Mr. Iglesias to the White House Counsel's office and the Department, and only after Mr. Rove was specifically enlisted by several prominent New Mexico Republicans in their effort to have Mr. Iglesias fired. E-mails demonstrate that shortly before the implementation of the firing plan, final circulation to "Karl's shop" was considered a "pre-execution necessity."

The precise role of White House officials, however, has been kept a mystery. After an initial round of false statements to Congress on that subject - including written misstatements that the Department was forced to correct, and false testimony that remains uncorrected to this day - Justice Department witnesses have been unable or unwilling to shed any meaningful light on the basic facts regarding who at the White House played what role in selecting these U.S. Attorneys for replacement and why. Also troubling in this regard is an incident Monica Goodling described to the House Judiciary Committee, in which the Deputy Attorney General apparently sent her away from a Senate meeting saying that her presence might prompt Senators to ask questions about the role of the White House in the U.S. Attorney firings and replacements. Taken together, these facts raise grave questions about the role of the White House and its political supporters in the U.S. Attorney firings, and about the Administration's extensive efforts to minimize or conceal that role. Only fair access to White House information will allow these crucial questions to be answered.

It may prove difficult however for the White House to produce the desired e-mails, however, since it has previously said some White House e-mailing was was conducted on Republican National Committee equipment and that some of the e-mails were lost.

Conyers and Sen. Patrick Leahy (D-Vt.) chair of the Senate Judiciary Committee, also issued subpoenas to Harriet Miers, the former White House counsel, and Sara Taylor, the former White House political director, compelling them to testify in July.

Taylor was in the news today even before the subpoenas hit. McClatchy reported that she was upset back in February when Justice Department officials told Congress that the administration pushed out the U.S. attorney in Little Rock, Ark. in order to replace him with a Karl Rove protege.

Can someone tell me at what point Congress is going to knock off the petty bull hockey and actually get down to doing the work they were elected to do? This nonsense with wasting time and money on subpoenas, or trying to pass an 800+ page immigration reform bill, or fighting with the President over Iraq are not what we elected these people for. What action is being taken on the high cost of gasoline? What about the current crisis in the mortgage industry with the sudden increase in foreclosures? Instead, we have elected officials taking fact finding missions to Greenland to see supposed evidence on global warming. If this is what we elected these people for, they are going to be counting terms in office on one finger.

It is incredible to see how apologists for this administration ignore the gross negligence of the justice department made evident by the recent congressional tenstimonies of monica goodling, kyle sampson, alberto gonzales etc...
Where is the accountability for important decisions made regarding important government institutions like the justice department? "I do not recall" does not cut it. If we as citizens do not expect honesty and integrity from those public servants who act on our constitution's behalf then we open the door to incredibly shady government abuse of its power.
Was it not Rove who said that these last 6 years where the opportunity to permantly implemement the structure to keep a republican majority? If this energy was put into the justice department we have serious issues that I think will come to light when these subpoenas make their way through the courts.

I remember when the Wingnut Party (Your Guys) impeached Bill Clinton for a stain on a dress and I can only imagine what the mouthbreathing rightwing would have done if they had caught Bubba useing the DOJ for partisan political purposes like the Commander Guy has been doing.

That's called playing politics, this is called breaking the law, little JD.


Any lawyer worth his or her salt will tell you that failure to comply with a subpoena is a serious matter. Invoking some sort of global 'executive privilege' over every single e-mail, document, or possible testimony is not legal. Yes, there are legitimate areas where executive privilege can and should be invoked. But casting a tent over the entire White House and refusing to comply is plainly unlawful.

The uber fascist Dan Burton sent over 1,500 subpoenas to the Clinton White House alone in case our wingnut friends have forgotten. (Clinton also complied with the vast majority of them.)

Red herring alert.

Congressional oversight goes to good governance, not law enforcement. If they decided to fire all prosecutors born in an odd-numbered year, do you suppose it would be appropriate for Congress to look into it? Or should Congress just pass it off because it was not illegal?

Moreover, lying to Congress does constitute breaking a law. As you Republicans well know, it's not the crime, it's the coverup.

Plenty by Republics, but if the US Attorneys didn't look the other way or started investigations they were fired. Why don't you get this?


Say, isn't this about getting to the bottom of what appears to be criminal behavior?

When it looks like republican leadership tried to push false democratic indictments and squash true republican investigations immediately before an election, isn't this a concerted effort to destroy our democracy?

So, to the republicans who nay-say this investigation: why is this a partison argument? Don't you believe in democracy too?

The RNC sent off-duty law enforcement officials to the polls and hung posters in heavily black neighborhoods warning that violating election laws is a crime."

The Washington Post continues: "In 1986, the RNC tried to have 31,000 voters, most of them black, removed from the rolls in Louisiana when a party mailer was returned. The consent decrees that resulted prohibited the party from engaging in anti-fraud initiatives that target minorities or conduct mail campaigns to 'compile voter challenge lists.'"

Now, dear reader, it is manifestly evident that black SOLDIERS SERVING IN IRAQ were targeting by this "caging" technique. They were not "living at their mailing address", ie., stateside, so the RNC sends lawyers to challenge their absentee ballots.

What is even more horrendous is that these US Atty's were fired for refusing to use their office to trump up bogus charges against Democrats, and/or refusing to give GOP crooks (e.g. Duke Cunningham) a pass.

Sorry,Dude. False analogy. As I explained to another talking point regurgitator, whenever a new President takes over, all of the attorney submit their resignations. They do it because they know when they are hired they are there at the pleasure of the President. (Remember Tony Snow saying that 500 times?) That means that Reagan accepted the resignations of all of Carter's U.S. attorneys and Bush II accepted the resignations of Clinton's. When you submit a letter of resignation and it's accepted, that's not being fired.


The truth is simple and that is that there are Democratic leaders in Congress supported by left wing radical groups like Moveon.org and funded by people like George Soros who hate Bush so much, it has become a literal obsession with them to see him destroyed and his Presidency reduced to ruins. What some would called Congressional policing is nothing less than a grandiose witchhunt with Grand Inquistors like Reid and Pelosi leading the pack. These people hate Bush so much, I would not be the least bit surprised if they continued to dog him long after he has left office. Sadly, the only way I can see them stopped is if voters wised up to what these elected official are really up to and voted them out of office, but I don't see that happening in the near future. These people are fueled by hatred and paranonia and right on, groups like moveon.org are powered by these exact same things.

Would you say the U.S. is more feared and respected in the world now, or before Bush took office?

After BushCo's disastrous blunder in Iraq, I don't think any of our potential enemy's are worried about our conventional firepower. And, there's no question we've lost respect throughout the world during Bush's tenure, there are dozens of polls that support this.

Re: Gonzales, Do you want the DOJ to be a political arm of the White House? These things work both ways, you know. Would you just say "business as usual" if a democratic appointed Attorney General and his staff fired U.S. attorneys midstream because they weren't towing the party line? U.S. Attorney's were never intended to be partisan hacks.


Is this worth the effort? Constituents of these representatives should be screaming at these clowns who are wasting time and money on political positioning instead of doing the people's business. I mean really, on the list of things that need done by the congress, this must rank far down the list. It just goes to show that BOTH parties are corrupt, bought and paid for by big lobbies, and we need to flush both houses every election until the message is clear...stop the political crap and do your job.


Clinton fired all but one US Attorney, including one that was actively investigating Hillary; no problem, the Attorneys serve at the pleasure of the President.

You know the party, in which even though the GOP candidate for governor in Washington won the election, won the first recount, won the second recount, but lost the third recount as "votes" kept mysteriously popping up in "warehouses." Or how about in St. Louis, in which the ballots never get counted until the tally from the rest of Missouri is in. Or how about in Wisconsin, in which several Democrats were sentenced to prison just last year for election fraud. Or how about here in Illinois?

JD: Having the Justice Department run on the basis of politics, rather than the merits of given cases, is arguably bad governance. It is apparent beyond any serious dispute that the firings were entirely political. Even if you dispute that this is, in fact, bad governance, perhaps you can agree that reasonable minds might differ on the point, which means it's reasonable to explore the question.

It's kind of evident that Gonzo's been lying to Congress about his role in the firings. As a Republicant, you are by definition unduly credulous about this admin, but let's face, anyone with a minimal level of discernment can tell that clown was lying.


If there is nothing to hide and no law has been broken why such a cover up and obstruction of Justice. I am so sick of this "I can walk on water because I can talk to Jesus" mentality.

Keep in mind that you are dealing with a group that believes the earth and everything on it sprang from the brow of an old man with a white beard. They also seem to abhor everyone who is not exactly like them. It is possible that, if left unchecked, they would make it illegal for Democrats (or gays, muslims, scientists, and the ilk) to breathe the polluted air in our country.

But, consider the source. Have pity. The poor things aren't capable of reason and logic.


Anyone who defends Bush and his administration is in the 29% minority in this country....


This issue is not as complicated as everyone is making it. These men serve at the request and honor of the president, and he can replace them anytime he sees fit, period! Congress has nothing to do with this process, and should stay out of it. When did we decide to let congress become the courts in this country anyway. They can not even do the work we have elected them to do, so they need to get back to the work of our country, and let the department do thier jobs as well. I have not seen one good thing come from this new congress, and not much from the republicans either. I would love to get rid of the entire lot and start over with men and women that want to lead this country.


It's funny how all the Republicans are calling this a waste of resources and a witchhunt when they spent all that time and money on Bill Clinton's Lewinsky Scandal. And what happened when President Clinton tried to take care of things that mattered, like fire rockets at Osama. You Republicans jumped down his throat for DISTRACTING the American people from the Lewinsky Scandal. Priorities aren't a matter of convenience so don't get so sour when your own republican officials are corrupt to the core and a few politicians are trying to expose and do something about it.

Congress has nothing to do with this process, and should stay out of it.

For some reason, the requirement that Congress approve mid-term replacements for federal attorney posts was removed by the last Homeland Security Act. And the Bush administration is taking full advantage of it.

The attorneys are appointed by the president, but they are here to serve US, the people. Using the DOJ to promote a political agenda, either by not prosecuting the party faithful, or overly aggressive prosecution of those with different political opinions is a perversion of democracy and a tremendous threat to our democracy. Everyone defending Bush on this should realize that there may come a day when another administration will do the same thing, only to their detriment if it's an extremist with a different political ideology than their own.

It would be a criminal act to fire a USA to stop an ongoing investigation. So far that is a real possibility. Until the congress is allowed to do their job and investigate, we don't know. This is an INVESTIGATION! This is not a criminal trial.

I know all you Repugnants have forgotten; but THAT IS CONGRESSE'S JOB for god sake. Just because the pugs stopped doing that for 6 years doesn't mean that it stopped being their responsibility. The Dems have 6 years of catching up to do since the last Congress was so worthless. BTW, I am a registered republican that this bunch of crooks lost back when Newt hit his stride. Remember the guy that lead the charge against Clinton’s morals for having extramarital affair while having one his self? I think we hit on something here, maybe we can stop our people from dying in Iraq for Cheney by accusing him of trying to distract us from the important issue of Paris's jail time. It worked for the Pubs and lead to 9/11.


It's shocking to me that so many people would write to say that this is all just politics when the very fabric of our democracy - the separation of powers - has been consistently erroded and ignored by the Bush administration. What does America hold sacred anymore when so many citizens are willing to look the other way while justice is so brazenly and broadly tainted? Yes, these prosecutors serve at the pleasure of the president. But don't you Republicans agree that firing the AGs to avoid prosecution of legitimate crimes is wrong? We have been sitting by quietly for too long while a president who does not share our American values uses his position to transform our national identity from greatness to common, ugly despotism.

To all of you idiots who don't think that this firing situation is a problem . . . Here is a lesson for you. Please read it before making more of your moronic comments.

The constitution sets forth the idea that the judicial branch of government is to remain independent and impartial to the bias of political parties, with the function being to uphold the rule of law. This is why Sup Court appointments are permanent, really to ensure that a judge at that level can interpret the law without worrying for his/her job.

In all new administrations, when the changeover occurs many appointed positions (such as these attorney positions) are restaffed. This is maybe an unfortunate oversight in some ways by the framers of the Constitution, but happens every time. ALL presidents, regardless of party, do this at the beginning of their term. But once this process is complete, the attorneys (or appointed judges, etc) are secure in the knowledge that they will be able to uphold and enforce the law as they understood it. The Bush admin has unconscionably replaced these people mid-stream for not following a certain political bias (Monica Goodling has testified under oath that this is the case). This is illegal, and it also TERRORIZES other attorneys, indicating to them that they now must uphold law with a measure of political bias to if they value their jobs.

So you morons who think that replacing attorneys at the beginning of an new administration is anything like the actions of replacing a selective few midstream really need to start thinking on a different level or go back to watching American Idol, because you don't understand the issue well enough to comment on it.

I'm not going to defend Democrats, sorry to disappoint. As best I can determine, all the top tier candidates in both parties are selling us out to the corporations, with both hands.

Conversely, the honest candidates, Democrats Dennis Kucinich & Mike Gravel, and Republican Ron Paul are on extreme opposite sides about certain monetary policies and philosophical principles, but all three are scrupulously honest and up-front about where we are at.

That is what separates them from the Big Boys (and Girl): honesty, and whom they serve: the Constitution and the People on whose behalf it was written, as opposed to the Bankers, the Corporations (who have no loyalty to ANY country) and the aristocrats of Europe, who never got over losing the War of Independence, much less the Civil War.

Why have no charges been brought?
By whom? The Department of Justice? (haw! haw! haw!)

Charges are not brought by Congress, except maybe "Contempt of Congress". Congress can impeach any official, which is effectively an indictment.

But Congress's first responsibility when faced with crimes committed by the Executive Branch, is investigation. It is important to establish the facts.

But, not to disappoint you utterly, charges were bought on this offense -- in 1981. Quoting from a subsequent appeal before the Third Circuit, Democratic National Committee, et al. v. Republican National Committee, et al., Ebony Malone, Intervenor, Republican National Committee, Appellant

"In 1981 the Democratic National Committee filed suit against the RNC and the New Jersey Republican State Committee alleging that they violated the Fourteenth and Fifteenth Amendments, inter alia, which was resolved by a consent decree entered into in 1982 which provided that the RNC will refrain from undertaking any ballot security activities in polling places or elections districts where the racial or ethnic composition of such districts is a factor in the decision to conduct, or the actual conduct of, such activities there and where a purpose or significant effect of such activities is to deter qualified voters from voting; and the conduct of such activities disproportionately i[s] directed toward districts that have a substantial proportion of racial or ethnic populations shall be considered relevant evidence of the existence of such a factor and purpose."

For the benefit of those unfamiliar with the term, a "consent decree" is:

"A consent decree is a judicial decree expressing a voluntary agreement between parties to a suit, especially an agreement by a defendant to cease activities alleged by the government to be illegal in return for an end to the charges."

In other words, the RNC loves to do this to black voters, has done so repeatedly in the past, got caught in 1980, and agreed to stop because that was a way to get the DNC to drop the suit. The "decree" part is that the judge certifies the agreement giving it the force of the bench.
