Patrick Leahy, the Democratic chairman of the Senate Judiciary Committee, is waiting by the phone.
Leahy, whose committee would take up the nomination of a permanent replacement for Atty Gen. Alberto Gonzales, sent a letter to the White House today suggesting he be included in the selection process.
To make his point clear, Leahy said he's available anytime after Labor Day, when the congressional recess ends, to meet with the president and his staff. He also suggested that his Republican counterpart on the committee, Sen. Arlen Specter, be included in the confab.
Here's the problem: anyone who has ever survived the slings and arrows of the dating scene in D.C. and elsewhere knows that this is simply no way to get a call back. Saying you're free anytime "after Labor Day" is just a few degrees short of desperate. (Or maybe this is a vein of humor that is best left unmined in the wake of Stallgate, or whatever label is about to hung on the Larry Craig episode.)
The last time Democrats were consulted on a big-time vacancy, the White House listened, ignored them completely, and ended up nominating John Roberts and later Harriet Miers to the Supreme Court. But that hasn't stopped Leahy from asking again. Some people never get the hint.

I WOULD SUBPOENA FRED FIELDING PRIOR TO ANY APPOINTMENTS TO GET A SOLID GRIP ON THE WHITE HOUSE INTERPRETATION OF THE CONSTITUTION AND THE EXECUTIVE POWERS UNDER THE CONSTITUTION. THEN, IMPEACH AND CENSOR THE PRESIDENT AND VICE PRESIDENT.
THEN AND ONLY THEN SHOULD HE ENTERTAIN A NEW NOMINATION.
ARLENE SPECTOR NEEDS TO COME CLEAN REGARDING WHO'S PEN WAS USED IN THAT BACK DOOR SIGNING THAT ALLOWED FOR SUCH CROYNISM IN THE JUSTICE DEPARTMENT NO CONFIRMATION HEARING PROCESS. UNTIL THEN HE TOO NEEDS TO WALK SOFTLY.

"It's sad that we live in a time when a talented and honorable person like Alberto Gonzales is impeded from doing important work because his good name was dragged through the mud for political reasons," Bush said.
What important work did the president have in mind? Was it the unwarranted firing of nine U.S. attorneys, some because they respected the law more than the political goals of the Bush administration? Was it his support for waterboarding and other harsh interrogation techniques that constitute torture, and his repeated attempts to undercut the Geneva Convention? Was it Gonzales' insistence, up until the beginning of this year, that the National Security Agency should be able to wiretap the communications of some U.S. citizens, despite the serious constitutional objections raised even in his own department? Politics caused Gonzales' downfall, all right. His inability to insulate the Justice Department from the political agenda of the White House guaranteed that his tenure would end in failure.
Bush's attempt to turn the tables - accusing critics in Congress of creating a "harmful distraction" - only shows his own lack of respect for the separation of politics and justice.
Like another in Bush's Cabinet, former Defense Secretary Donald Rumsfeld, Gonzales outlasted his credibility. He should have resigned months ago.
Bush's defiant rebuke to Gonzales' critics - a group that includes some leading Republicans - raises doubts about his ability to select an attorney general who will restore professionalism and morale in the Justice Department.

Bush should appoint whoever he wants and thumb his nose at Leahy and crew. Since there is a little over 1 year left in his presidency, this appointment could server as a recess appointment and will not be subject to Senate approval. I wonder if Bolton or Wolfowitz are interested.

Pat Leahy is not a nice man he leaked intelligence in the 80's and got thrown off the Intelligence Committee and co-chairs Justice Committee. I think W should ignore him. RINO Arlen Specter almost lost his lunch to Pat Toomey in the primary and if W hadn't helped his sagging campaign he wouldn't have won a very close race. Specter is for Specter period.
Both Depends and Specter are no help to W forget this bunch W and do your own thing starting with the veto pen to all their bills. Jerry White, Springfield, IL P.S. There's something in the water in Vermont: Jumpin Jim Jeffords, Socialist Bernie Sanders, Howard Dean and Leaky Leahy.
