Homeland Security Secretary Michael Chertoff and members of his department have reason to be more frustrated today. A federal district court judge in San Francisco placed a temporary injunction on the department's effort to crack down on employers who employ illegal workers.

The injunction freezes the federal government's efforts to use so-called no-match letters in which employers are informed that workers' Social Security numbers don't jibe the government's records.

After being informed of an inconsistency, workers have a chance to show that the government's records are wrong. If they can't, employers are bound by law to fire those workers or face federal fines and even criminal sanctions

Labor groups, the American Civil Liberties Union, the U.S. Chamber of Commerce and immigration groups joined together to sue the federal government, claiming that mistakes in the federal database would penalize workers legally entitled to work in the U.S.

U.S. District Court Judge Charles Breyer essentially said that not issuing an injunction would cause more harm to employers and workers than to the federal government.

The magnitude of DHS’s safe harbor rule is staggering. If enacted, DHS will immediately mail no-match packets to 140,000 employers, identifying no-matches for approximately 8 million employees. There can be no doubt that the effects of the rule’s implementation will be severe.

Thousands of employers would bear the “significant” expense of complying with the
rule’s new 90-day timeframe. See Dickson Decl. ¶ 4. Because there has not been an official
timeframe for resolving no-match letters in the past, employers have generally resolved
mismatch problems “at their leisure.” See id. ¶ 7.

Therefore, many employers who want to take advantage of the safe harbor provision will have to develop costly human resources systems capable of resolving problems within the new time frame. See id. (“[H]uman resources departments will have to put systems into place designed to resolve mismatches with the employee’s cooperation with in the ninety-day window,” which “will take time and money to develop and implement.”).

The union plaintiffs have also identified ways in which employees will be irreparably harmed. Kenneth Apfel, ex-Commissioner of the SSA, believes – based on his prior experience at the agency – that “there will be many legally authorized workers who cannot resolve a mismatched earnings report” by the deadline imposed by the new rule. See Apfel Decl. ¶ 17. Because empirical research suggests that mass layoffs often follow receipt of a no-match letter, see Theodore Decl. ¶ 11, there is a strong likelihood that employers may simply fire employees who are unable to resolve the discrepancy within 90 days, even if the employees are actually authorized to work. On the other side of the scale, a preliminary injunction would cause significantly less harm to the government. The government argues that a preliminary injunction would preclude SSA from sending out no-match letters for the 2006 tax year, “and so frustrate the purpose of providing notice to employers that their employees’ social security earnings are
not being credited to their accounts.” See Opposition at 54. But the plaintiffs have not requested a preliminary injunction precluding SSA from sending out its traditional no-match
letters for tax purposes, as the agency has for over a decade.

Chertoff had hoped that a comprehensive immigration-reform package would pass Congress earlier this year and be signed by the president in order to standardize the process whereby employers verifiied the legal work status of employees.

But that didn't happen, largely because Americans who wanted tougher immigration enforcement scuttled an immigration deal brokered by the White House. Those voters demanded stricter enforcement of existing immigration laws first before any immigration deal was reached.

So the Bush Administration decided Chertoff's department would get tough.

But the department has been thwarted in its efforts to enforce the laws on a piecemeal basis. A program called E-Verify it had hoped to get underway in which employers would check workers' legal status using a Internet link to a federal database met an obstacle when Illinois declined to go along, telling companies they would be in violation of state law if they did. The department is suing in that case.

Today's federal court injunction is just one more frustration.

In a statement after the judge's decision, Chertoff said:

Although the Judge rejected many of the plaintiff’s legal challenges to the department’s no-match regulation, we are disappointed by the district court’s decision today that temporarily continued the injunction against the regulation. We are reviewing the decision with the Justice Department and will examine all of our options, including appeal.

The no-match regulation gives employers clear guidance on what to do if they receive a letter from the Social Security Administration communicating that an employee’s name does not match the social security number it has on file. If an employer follows the regulation’s guidance in good faith, which entails various steps to rectify the no-match within 90 days of receiving the letter, U.S. Immigration and Customs Enforcement will not use the letter as evidence in an enforcement action against the employer. If the company does nothing to resolve the problem it can be held liable for employing an unauthorized worker and could face stiff penalties or sanctions. Ultimately, employer diligence will make it more difficult for illegal aliens to use a fraudulent social security number to get a job.

President Bush made clear in August that we are going to do as much administratively as we can, within the boundaries of existing law, to further secure our borders and enforce our immigration laws. Today’s ruling is yet another reminder of why we need Congress to enact comprehensive immigration reform.

The American people have been loud and clear about their desire to see our nation’s immigration laws enforced. We are taking aggressive steps at our borders and in the interior to do just that and the no-match regulation is an important part of our efforts. We will continue to aggressively enforce our immigration laws while reviewing all legal options available to us in response to this ruling.

Meanwhile, the federal government's opponents were, not suprisingly, pretty satisfied.

Today, the court’s unequivocal decision to stop the “no match” madness is a victory for all workers and all well-meaning employers. The federal court has seen the Administration’s social security “no match” regulations for what they are—an illegal, ill-conceived measure that would threaten thousands of innocent workers and lead to discrimination and massive workforce disruptions.

Today’s decision sends a clear message that punitive crackdowns that attempt to sidestep the law will not be tolerated. Efforts to fix a badly broken immigration system must embody our good sense and our humanity. We will not let an intolerant minority undermine the wellbeing of the majority.

It’s time to stop this growing current of unwise, enforcement-only immigration measures that are making life increasingly miserable for many of our nation’s hardest, most underpaid workers. It’s time to stop the indiscriminate round ups and get back to finding solutions that strengthen—rather than divide—our nation.

Inreresting, eight million no-match notices to employers. Last Friday the Labor Dept. reported that there were seven point two million unemployed in the country. Even if we could match our current unemployed with the pickers, pluckers and roofers we could not replace the illegals in their jobs.
Maybe we should hold up on the troops, concentration camps, guard dogs and tattoos until we have more unemployed to fill the jobs.


Once again, the anti-American people forces are at it again. The ACLU hates Americans. The Chamber of Commerce is only interested in cheap labor. Meanwhile, the American worker gets screwed.
For all the Lefties who whine and cry about Americans losing good jobs, it's getting so that the illegals are getting high-paying construction jobs (course at lower pay than the American worker would get) and other jobs we allegedly "don't want."


I am deeply disturbed by the liberal Judge Breyer's blocking of Federal efforts to clear our work sites of illegal aliens, fraud and other crimes perpetrated by those residing and working in the United States illegally. Not to mention corruption of our social security records with garbage caused by illegals committing multitudinous crime!
The Democratic Party and the pro-illegal organizations are well along in dissolving the sovereignty of the United States, and its satute rule of law. It seems almost like a science fiction nightmare to learn the nation is infiltrated with people for whom the ideal of an organized U.S.society has no meaning! We are hurtling toward destruction from within, simply because those who are in power do not honor their own government and its real citizens. These same individuals have sworn to defend us!
When total anarchy presides from these kinds of mindless rulings, which are very injurious to the citizen at large, no one will be victorious.

Economic problems can always result in recovery. Loss of our Government effectiveness in our defense cannot. Blood will be spilled eventually unncessarily. This kind of damage the Judge has performed on the United States is worse than anything that can happen in the war in Iraq!

Felix, don't you know that we U.S. citizens are to bend over and bow down to the immigrants? That we are to accommodate them in every way possible? Why not just tell illegals "come on in, welcome". We should be doing everything we can to correct and prevent identity theft by illegals. But no, there is more concern for their "rights" than the rights of people whose number/identity they stole. As I see it, they are not citizens. They are to entitled to the rights that a citizen has. In my view, they have two rights.
1. the right to go/be sent home.
2. the right to come forward, admit their status and face the music.

They have no rights to insurance, retirement or any other benefits. They are certainly not entitled to Social Security. SS cannot afford the legitmate people, much less illegals that siphon that which they are not entitled. They have no rights as an employee, as they should have never had the job in the first place.
I know this is cold. But their are over 12 million illegals now. As long as we have corrupt judges like this smoothing the ice, they will just keep sliding in. I feel it is time to stop beng nice. It is time to do sweeps like this article speaks of with unbridled diligence. Until these people start seeing their peers being caught and deported in numbers, they know that once they get here they will stay here.

Wow, I could not have articulated this better. If I immigrate LEGALLY to another country, I will not be given my own National Holiday. These people are greedy, self serving people. As I just stated, they have NO RIGHTS WHATSOEVER as long as they illegal. I take that back, they have teh right to be arrested and deported. It is time to take off the gloves and draw a line in the sand. If you are here illegally, we will do everything we can to get you out. The arellano lady was a good start. Oh, and each illegal ddeported may take whatever family members they want with them.
It is funny that they becry that deportation seperates families. What about their families in Mexico? They had no problem leaving them at all. But, I am not cold hearted. We will do everything we can to ensure that each and every family member can go with them, in order to preserve the sanctity of the family.

If it were not for your inane ability to use chilish name calling, you would not have much to say would you.
Yes, they are human beings. I am not concerned with their motivation for coming here. They did it illegally! A person looking for a "better life" does not hole up in a truck with 80 other peeople, steal an identity, and live like a rat to avoid detection. Also, I could care less about Bush/Cheney and their politics. Where in my posts to you find any correlation to Bush or any other criminalition?
Unlike you, I do not need alterior motives to justify my opinions. I do not need to resort to petty stabs at people's opinions. I can be up front and tell anybody how I feel without pre-juvenile comments.
I have disdain for these people because they are criminals. I have disdain for them because they leech money and benefits they are not entitled to. I have disdain because they make no attempt to adapt to their new country. If they were truely lookijng for a better life, they would be working hard to acheive a functional use of the language. They would be doing everything they could to make the most out of their "new beginning". They would not need an interpretor to order a Big Mac.

There will be a day when the U.S. will need the help of other countries and they will give them their backs. The U.S. may be a powerful country today but in a split of a second all gone. Welcoming diversity is a must in this country. If you take it away it's like fighting World War 2 all over again in Germany.
How many US citizens travel overseas every year and expect the other county to speak its language? Most foreigner speak 2 languages at least. How many languages do the majority of Americans speak? It's a shame this country is so powerful but at the same time so very ignorant.


To all of you illegal "haters" out there you are very blind and ignorant to the real reasons they are here illegally and the real reasons they are being used as scapegoats. I think someone did cover that they are being uses as scapegoats to cover up the REAL issues that should be on the campaign issue list. It is our own govenments fault that they cannot come here legally so they do it illegally. The government has made it almost impossible for the ones who really want or need to come to be able to do it legally. You have no clue what kind of paperwork, money and time you have to put into coming to this country if you are poor. Some of these people are very intelligent and gifted people who contribute many wonderful things to our society. If you would take the time to go spend a week or maybe a month if you think you can handle it! Living in the places where they come from you know put yourself in their shoes for awhile you might have a better understanding of why they do leave and come here hoping to help the rest of the family they leave behind be able to survive. Not all of them are from Mexico and they are not coming here to over take the country. I can say I have been to the places where they come from and I have lived in their shoes and I know and understand what good people most of them are and why they come here. Can you imagine having to live in a dump and scavage through the garbage brought in each day to look for food or something that you might be able to sell to buy food with. Or selling your 6 or 8 year old daughter to a truck driver to have sex with for $1 so your family could get food? Whether you want to belive it or not things like this exist - they do. Here they live in some of our most run down places and they feel they are living like kings because they aren't living in the dump, they have running water, or bathroom and a roof over thier head. They are able to help their ill parents or children or wives back home pay for medication or treatments that they would otherwise not be able to get. There are some many things I would love to say, but I will keep it brief. Don't continue to let the "lying" politicians continue to lead you around with blinders on any longer. Open your eyes and take a look at the "real" problems in this country and how some of them are being helped by the immigrants that come here legal and illegal. And you know what most of them don't want amnesty to stay here. They just want to be "legal" so they can do it the right way, but we never gave them a way or a chance to do it the right way. If we could make it where they could do it legally they would. And when you say they can take their family members with them do you ever think of the American family members that some or many of them have. Let me respond with BS. It is the illegals themselves that "cause permanent damage to some of our up and coming." They cram them into overcrowded vehicles. They expose them to people who die on the trip. IT IS THE FAMILY THAT EXPOSES THEIR CHILDREN TO DEATH AND IMMORAL BEHAVIOR. People from other countries seem to be able to use the immigration program without near the difficulty of illegals. You can dress it up all you want.
The fact that other crimes and ills exist does not justify people coming here, steaing identities and sucking beneftis that do not deserve. Using your logic, all of the rapists that claim the victim was "asking for it" are correct. Yes, there is a lot of paperwork, the process not easy. This is to ensure that the poeple coming in are or will not prove a danger to America. Recent events have shown that the system is not fullproof, but it is better than a society that lets people sneak in like rats and do nothing to remove them. I firmly maintain that anybody, FROM ANY COUNTRY, that is here illegally does not belong here and should be returned to their home country. If you want something bad enough, you floow the rules to get it. Otherwise you are nothing but a criminal whose only right is to be deported.
I do not fell a "hatred" for these people, anymore than I do for any other criminal. I would just like to see our country take a stand. If enough illegals see their peers being sent home, it might inspire some to try it the legal way. You claim the benefits that illegals can provide to our country. However, it seems to me that a majority are just looking for a free ride.
So, yes I believe tat all illegal aliens should be sent home. Then they can try it the legal way.

YEs, I have met several illegal immigrants. When my neighbor and I discovered that the lawn care service in the neighborhood was employing illegals, we let the owner konw we were going to report it immediately to the authorities. This is not a stereotype. I am not inferring anything on any immigrant that is here legally. I do not lump all members of a race together as a result of one facet of the race.
As for me, I am a Social Worker. Have been for over 22 years. I have great compassion for people that need and deserve it, of any race or nationality. I currently work with adults with Developmental Disabilities. I carry a caseload of 65 people. This include hispanics, and many other races and origins.
As I have stated, I do not feel the illegals have any rights to speak of, including sympathy or acceptance. They have the right to be sent home, or step forward and begin the legitimate process of immigration. So, if you want me to make comments that show my compassion for others, go to other articles.
Yes, my views are hard on THIS ISSUE. But those are my views on THIS ISSUE, PERIOD. To infer ones opinion on one topic can define their entire mind set is not realistic. This issue is not one that will get better with compassion. It will not get better with tolerance or reform. We can already see how this does not work.
So, when it comes to illegal aliens, no, I have no compassion or empathy for them. They chose their life. When one makes a choice, the consequences fall on them. A lady died in a fire last winter I believe. This was a result of her heat being shut off, and she knew if she reported it she would be deported. This is a better life?
If they want my help, I will arrange for the authorities to give them safe and comfortable transport home.

If the government rounds up all the illegals and deports them as you so rabidly desire, would you support increasing the number of legal immigrants from central america allowed into this country?

I think I have made it clear that if a person follows the immigration procedures, then I am fine with that. Where in any of my posts is any comment regarding me lumping them all together. I have only spoke of illegal aliens, period. Yes, I realize that there are illegals of probably every nation here. But the vast majority are hispanic.
My best friend "Nino" was in my wedding party. I have close friends that are African American, Hispanic, Polish, German and Muslim. My boss for 5 years was muslim, and he gave me great insight into the muslim religion. I have no disdain for any race at all (my neighborhod is over 85% black). But if you are here illegal, then you should be deported. If a person applies for immigration and follows all of the laws and regualtions, they are welcome, no matter where they are from. So, please copy from any of my posts where I "lump" illegals in with other members of their race that are here legally.



Oklahoma no longer OK for Illegal Aliens. Every State needs to do this!!!!

Oklahoma's Governor Brad Henry has signed a sweeping immigration Reform bill:
House Bill 1804 that its sponsor believes will go a long way in dealing with the illegal alien problem in the state.

House Bill 1804 was passed by overwhelming majorities in both the House and Senate of the Oklahoma Legislature. The measure's sponsor, State
Representative Randy Terrill, says the bill has four main topical areas: i t deals with identity theft; it terminates public assistance benefits to illegal; it empowers state and local police to enforce federal immigration laws; and it punishes employers who knowingly hire illegal aliens.

Oklahoma is no longer "O.K." for illegal aliens, Terrill observes. "When you put everything together in context," he contends, "the bottom line is
illegal aliens will not come here if there are no jobs waiting for them, they will not stay here if there is no government subsidy, and they certainly won't stay here if they know that if they ever encounter our state and local law enforcement officers, they will be physically detained until they're deported. And that's exactly what House Bill 1804 does."

The Oklahoma legislator is pleased the bill he sponsored into law was signed by Governor Henry and believes it will go a long way to curb the illegal immigration problem in the state. "I would remind people that states are separate sovereigns in our federal system," Terrill points out. "Anyone who doesn't understand that needs to go back and take an American federal government class in college," he says.

As a result of that sovereignty, the Oklahoma lawmaker insists, "we have as much right - in fact I would argue, a responsibility - to protect our tax
payers against that sort of egregious waste, fraud and abuse as the federal government should have a responsibility to protect that international border,
but doesn't do that."

Terrill says as long as the federal government refuses to do its job of protecting the international borders of the United States, like Oklahoma must take action to deal with the problem that is costing taxpayers in the state $200 million a year in public benefits, law enforcement costs, and other resources.

There you go my friend. The fact that they are not white is obviously an issue for you. Why else would you make an explicit comparison to the white poulation? Why not the poulation as a whole? And then you go on to assume that their children will all be criminals, again presumably at a higher rate than "white citizens" because they are "brown citizens".
