There are a lot of "ifs'' in the "nuclear option'' that Sen. Hillary Clinton's campaign could consider for claiming her party's nomination, the way Tom Edsall tells it:

If Clinton does well or outright wins in Indiana and/or North Carolina this week, if her argument for electability takes hold and if enough party activists are willing to withstand the revolt that would ensue, Clinton could force a vote of the party's bylaws committee to seat the disputed, Clinton-rich delegations of Florida and Michigan and overtake Barack Obama's delegate lead.

The Clinton campaign, however, maintains that it has no "secret plan,'' and has posted on its Web-site something on this subject which is included on the jump of this Swamp posting. Read more here, and hear from camp Clnton below:

"Hillary Clinton's campaign has a secret weapon to build its delegate count, but her top strategists say privately that any attempt to deploy it would require a sharp (and by no means inevitable) shift in the political climate within Democratic circles by the end of this month,'' Edsall writes in The Huffington Post.

"With at least 50 percent of the Democratic Party's 30-member Rules and Bylaws Committee committed to Clinton, her backers could -- when the committee meets at the end of this month -- try to ram through a decision to seat the disputed 210-member Florida and 156-member Michigan delegations,'' Edsall suggests. "Such a decision would give Clinton an estimated 55 or more delegates than Obama, according to Clinton campaign operatives. The Obama campaign has declined to give an estimate.

"Using the Rules and Bylaws Committee to force the seating of two pro-Hillary delegations would provoke a massive outcry from Obama forces,'' he notes. "Such a strategy would, additionally, face at least two other major hurdles, and could only be attempted, according to sources in the Clinton camp, under specific circumstances:

"First, this coming Tuesday, Clinton would have to win Indiana and lose North Carolina by a very small margin - or better yet, win the Tar Heel state. She would also have to demonstrate continued strength in the contests before May 31.

"Second, and equally important, her argument that she is a better general election candidate than Obama -- that he has major weaknesses which have only been recently revealed -- would have to rapidly gain traction, not only within the media, where she has experienced some success, but within the broad activist ranks of the Democratic Party.

The Huffington Post describes a "secret" plan that the Clinton Campaign has to seat the Michigan and Florida delegations. There is no secret plan. In fact, this story misrepresents the process laid out in the DNC rules for resolving the questions surrounding the seating of the Michigan and Florida delegations.

The Clinton campaign has been vocal in stating that the votes of 2.5 million people must be respected. Hardly a day goes by when a Clinton official doesn't publicly declare that the votes of Michigan and Florida count and that the delegations from those states should be seated.

DNC members from Michigan and Florida have filed challenges with the DNC to seat the Florida and Michigan delegations. The process being followed to adjudicate these challenges is completely consistent with the DNC rules. The Rules and Bylaws Committee (RBC) is the DNC body charged with dealing with these challenges until the 56th day before the convention, and its process is public and transparent.

The membership of the RBC does not - in large part - turn over. A former Secretary of Labor, and the grandson of FDR who is a long time party activist and has been a co-chair of the committee for several election cycles chair it. Other members include a former chair of the party, Al Gore's Campaign Manager (who is a former co-chair of the RBC as well), and an executive board member of the NAACP. Although the RBC is comprised of people who support both candidates, these people take their roles as party activits seriously.

The DNC process will decide the fate of the Florida and Michigan delegations. It is an open and transparent process -- unlike the backroom deals proposed by the Obama campaign that would disenfranchise the nearly 2.5 million people who voted in Florida and Michigan.

what many people lose sight of is the fact that the democratic primary schedule was intended to give voters the opportunity to get to know the candidates. Hillary and Bill have been backslapping cronies and talking up superdelegates for years. No one even knew who Obama was, other than the lies circulated on the Internet. That's all that America needs to show a wary world---that if things don't come out the way we want, we'll just change the rules. again.

The party has reached the point that they can't wait for Hillary to drop out because she won't.

They plan to oust Hillary then reinstate Michigan and Florida. They won't stand a chance in winning the November election with Michigan and Florida gift wrapped to McCain. This is common sense that the Elites may be deficient.

Hillary would make a better President than Obama . Listening to both of them speak, Hillary is more clearer on her solutions of the issues. Obama skates around them. In addition to shamelessly pandering to the electorate, and despite her "policy wonk" image, Billary has no core intellectual integrity regarding policy. She can't admit that her gas tax repeal plan is bad policy (in fact she intends to introduce it as a Bill in the Senate), she'll lie about the policy rather than address the truth, and she'll use her supposed understanding of government policy to distract and mislead the public.


Hillary's war with reality in these primaries would continue in the White House and good policy would be secondary... we already know what that is like.


America has gotten to know Obama and we don't like what we see--an arrogant, opportunistic,amateur politician, who lacks courage and character. Who also won't be elected in November. Thank goodness the primaries have gone on so we might not be stuck with Obama.

The energy issue is as big as the United States is wide and Clinton is offering you enough value to drive you out your driveway to the road and then your car runs out of gas.


Why does she not get out her toolbox now? What is in it to solve the energy crisis and reduce America's cost and reliance on oil and gas? A better analogy is that she is not even "nickel and diming" this one. She is offering only the illusion of nickels and dimes.


I think her and McCain's more important purpose is not to disturb the oil and gas industry. This gives them a pass there and if the people actually bought the illusion, then its too late for the populace to challenge oil and gas because the election would be over by then.


I guess I would describe an elitist as someone that might think there are people foolish enough to fall for this illusion. She must think this is really clever of herself. If she actually believes this stuff herself, it tells me in fact she is not Presidential material.


Another note, I see George didn't ask her the right question on the commander in chief test. It is not whether Obama passes it, it should be - (a) what is the test and (b) how did Hillary pass it?


Was it what happened between her and Bill after Monika? Was it the hail of bullets in Bosnia? Was it her peace negotiations in Ireland? Was it her Daddy showing her how to shoot the gun behind the barn when no one was looking? Was it hearing about Bill's war stories from Vietnam? Was it her service to the army or navy or marines? Please, let's get real. She has absolutely no credibility and could not win a head to head on this issue against John McCain. He can easily define the commander in chief test in a way that is exclusive to him.


Hillary at most can argue that she may be equally suited compared to Obama. Obama has the edge over her as the Democratic candidate because he is leading a change mandate and we need someone that is not mongering for war. Just look at Hillary's comments about obliterating etc.


The last thing America needs now is another war. It must first extricate from the one in Iraq in a sensible way. And then, redirect all of that energy and money to solve its deepening crises.


The way the Democratic party has been treating Hillary-If she is not the nominee, she should go INDEPENDENT! In a three way race she Would win. I can't believe what has been found out about Obama and his minister, and he Still has Demonuts going for him. HE WILL LOSE IN A GENERAL ELECTION. HE CAN"T WIN! I BELIEVE he would make a fine Vice-President. He needs to actually do something first before trusting him to the most important job in the world. Hillary would carry on and finish off where her husband left off. Better economy for all. Don't you all remember how great the 90's were?

False. The MI and FL parties did break rules. They supported the new earlier dates for the primaries--thought they didn't have to. The Republican primary date was changed as well, knowing--at that time--the Republican primary delegates wouldn't count. The Repbs. decided to let 1/2 of the delegates count.

The DNC set its rule before the FL. legislature made its new policy.

Without FL. Dem support of the primary change policy, it wouldn't have passed since enough Repubs were opposed to it, too.

As well. the FL Dems could have made arrangements--with the DNC--to set up an alternative Dem party only primary, but didn't.

What about all of the Dems who didn't even vote since they'd been told months earlier that their votes wouldn't count? One of those telling them that was Hillary. They've been disenfranchised--even more than those who voted if those votes end up counting.

Hillary only got 50%, Bema 35%. What happens to the 15% that didn’t vote for either? Where do those delegates go? Come from?

At that time, people barely knew who Obama was, whereas Hillary's been known nationally for 16 years.

Should the FL> and MI "votes" "count?" NO, that's changing rules after the fact to benefit one candidate over the other. That's sleazy B.S.

MI. and FL. have grievances, but not with the candidate--except for Hillary, who has changed her position about those votes "counting." Obama is consistent following existing rules that he, Hillary at al. supported well in advance. Should he be punished?? Wait a minute. Howard Dean- you know the party chairman who sounds like a petulant child while openly disagreeing with his party's leading vote-getter on national television ("He [obama] can say whatever he wants, I'm going to say what I want')- says he wants Florida and Michigan seated.
How is it that Hillary would be creating the "nuclear option" when the DNC has basically admitted for the last two months that it screwed up by disenfranchising the voters of their party in those two very populous states?
The rules and bylaws committee is there to make just such calls on disputed delegations. Is it Clinton's fault that she has more people on that committee than Obama does? Or that she had the foresight to put her name on the ballot in what looked like, and became, the only chance the democrats of Michigan and Florida would have to go to the polls?
I can't feel sorry for Obama in such a situation. He had just as much chance to get on the ballots as Clinton did. But he was dumb enough to believe that Howard Dean knew what he was doing. Never, EVER a good bet.


I am taking bets as to what Hillary will come up with to get votes in Kentucky..... It will be interesting. She has pretty much used up everything including amending the Constitution to allow Guam to vote in the general election. She is testing that theory to see if it is popular and then she will promise the same to Puerto Rico. Since low level voters in Indiana don't read, They will never know what a bad idea this gas tax holiday is. We have seen how Hillary intends to fight. A lot like George Bush.
It scares me that so many Republicans including Conservative media is pushing so hard for Hillary to win the primary.
"She will be the best candidate to face McCain in November" they shout. If you believe that I have a piece of swamp land to sell you.


I'm from Michigan. We had no Democratic primary. An election with only one person's name on the ballot is something out of the old Soviet Union, not a Democratic Primary. A lot of Michigan Democrats, knowing their vote wouldn't count, crossed over and voted in the Republican race.

Despite that, the Clinton manipulators are trying to claim victory, and have even been doing their best to get their people appointed to the "uncomitted" delegates as well! Those were votes for "anybody but Clinton" in the primary.

Seating the Michigan delegates that have been selected by the "primary" and local party bosses is worse than the the G.W.Bush brand of lying politics.


I can't feel sorry for Obama in such a situation. He had just as much chance to get on the ballots as Clinton did. But he was dumb enough to believe that Howard Dean knew what he was doing. Never, EVER a good bet.

If Hillary plays it like that, she will lose in November. Period. The only people who want her to do that are Republicans who want her to split the party. She should do her best to finish strong and recruit Democratic voters in the states that are left, but she should be careful about who she listens to when ideas like this "nuclear option" come up. If she has to have the votes in Michigan and Florida counted as is to win, then she is done and should hang it up 'til 2012. I'd much rather vote for her than McBush if she wins, but I'll go Nader or stay home if she pulls that kind of crap.

If FL and MI's delegates put Clinton over the top, I will campaign for John McCain.

Hillary agreed that FL and MI were off the table. Now, because she's behind, she wants to include two states in which neither candidate campaigned?

All of the super-delegates better decide NOW whether rules matter.

And if they decide they don't, then they should never ever again complain about 2000 and they never ever should have rules in the future.

Go ahead, Hillary, make the argument that your word means nothing. That's a sure winner for November.


Hillary's statement about obliterating Iran - was as stupid a comment as I have every heard. You NEVER say a thing like that, even if its what you feel. Isnt that kind of talk - that makes the terrorists evil? So why do you make a comment like that? And why do you go on national tv and pretend that you were under fire - while troops are under real fire? The answer is old politics. The Clintons are up to their eyebrows in promises they made because they feel like the whitehouse is theirs already. They thought the election was a mere formality. Their sense of entitlement is so bad that good solid people have abandoned them. And they are calling people "Judas", two day before Easter, because they don't care about ANYTHING but getting back in the whitehouse. These are Callous, Ruthless, Crass individuals, who have severed-through-insult, every positive relationship they had with minorities. For what? MONEY and POWER.


What the Clinton camp doesn't admit to now is that before Super Tuesday, when Michigan and Florida violated the rules and ran early Primaries, the Clintons were fully in support of stripping those two states of their delegates and punishing them for moving up their primaries.

Only now, with Clinton losing, is Hillary complaining and lying once more by saying "I've always stood up for the right of these two states being seated with all their votes." She has once again been caught in lies and deception and is in the process of getting away with it. Is this what we want running our country? Dear Goddess, I hope not.


Barack Obama should step down! He knows as well as the rest of the country he has been vetted as the weakest of the three candidates. If he is truly concerned about making sure the Democratic Party wins in November and truly wants to put an end to Republican Rule, he will step down for the betterment of the party.


Hillary SIGNED a pledge that she would stay out of the Michigan and Florida primaries. No advertising, nothing and that they wouldn't count. No she is going back not only on her word, but her signed pledge. And who thinks she won't go back on anything else that is inconvenient for her?
As a woman I wish I could vote for her, but as a person who wants a President with integrity, I can't.


The mandatory penalties set forth by the Democratic National Committee’s delegate selection rules call for outlaw states like Florida and Michigan to only lose half of their delegates to the national convention. And yet the DNC went beyond its own rules to add further penalties, stripping those states of all delegates.

The DNC rules also prohibited public appearances and electronic advertising before the polls closed by candidates in states that had jumped the approved primary calendar. Barack Obama made a public appearance in Florida in September 2007, talking to reporters after a fundraiser. His campaign also bought television ads on cable news outlets that ran throughout Florida before its renegade primary.

Strictly speaking, if the DNC rules were tightly construed in this case, Hillary Rodham Clinton would receive half of the Florida delegates she won and Obama would receive none — the penalty for violating the campaign ban.


It is pretty sad that the only way Obama can win is to disenfranchise millions of voters in Michigan and Florida. His campaign has fought hard behind the scenes to keep those states from revoting either. He will pay for it in Nov. How can he not allow those 2 states to not vote. That is a travesty and is reprehensible. Anyway you look at it more people have voted for HIlalry than Obama.


Brainwashed, use the contraction "you're" when trying to say you are. Enlighten me as to how what I said was propaganda. Didn't Howard Dean say for months that "rules are rules" until two months ago when he said Michigan and Florida should be seated? Didn't he disagree with his own candidate (Obama) on Fox News Sunday? Back your statement up.


None of that matters- The internicine fight has done enough damage to either Democrat that neither will win in November. Get use to "President McCain".


Read up on the facts. It is NOT Obama disenfranchising voters. It's Hillary trying to twist the rules her way--breaking from her promise to honor the DNC guidelines and NOT add those campaigns. The other candidates, including Obama, honored his agreement. In fact, his name wasn't even on the ballot in Michigan. It's a messy ordeal and one that shouldn't be solved with total disregard for party rules and ALL concerned candidates and voters. Hillary's campaign management has proven shoddy and ridden with controversy. Her pandering to voters by with a fluffy gas tax holiday proposal, her winning-at-all costs campaigning, her lies, lies and more lies, and long list of dirty GOP tactics make her less and less appealing every day. Americans are tired of the same old tired politics evident in the last 8 years. Hillary represents more of that. Both she and McCain are cut from the same cloth. I used to respect her but quite honestly, the more research I do on Hilary, the more I see that she is a liability for the Democratic party come November. Indeed, a complete expose on the truth about Hillary would "obliterate" her from candidacy.


Jeff, Dean did say he wanted the delegates from Florida and Michigan seated. He did not say how they would be selected or how many would be seated. I believe the Republicans cut their delegates by 50%, for example.

Her so-called blue collar supporters are probably not paying attention to these details? Probably not aware that she cannot balance her campaign budget or pay her bills. Probably not aware there's that suborning perjury drama going on with Peter Paul and there are supposedly depositions coming up in NY. Then too, this way of going about seekingn the office with no regard for what is true or healthy or decent or wholesome or inspiring or presidential, more her tactics resemble those of a mob boss and not an official. I do wish her supporters were paying attention to these details. This is not a person I would like to have "fight" "for" "me" since her idea of fighting lacks all human decency, all moral courage, and all integrity. I do see that there are superdelegates, however, that are following these 'details,' and that electability is a concern. I wonder if ethics, the ability to collaborate, truthfulness, or sanity are concerns to them. I am sure that there are superdelegates who do not want to risk the wrath of the Clintons or the wrath of their own constituents. Last I heard. two female superdelegates from WA state were supporting Clinton while Obama won the WA state primary and caucus. Chances are those woman have a feminist motive or feel they have debts to the Clintons. But where is their justification for overriding their own state's voters?


Okay, here's a partial explanation of this looming disaster. From Detroit News, begins talking about Michigan. You can see that the Clinton camp thinks anything less than getting an advantage there is considered giving advantage away. This was election as John Stewart says "Soviet Style," only one person on ballot ... here's what DetPress says?

Clinton won the disputed January primary, while Obama took his name off the ballot here. Based on the results, Clinton would win 73 delegates, with 55 uncommitted delegates going almost entirely to Obama. The "Group of Four" plan would cut Clinton's edge from 18 delegates to 10.

Also Monday, the Clinton campaign did not entirely dismiss a report on the Huffington Post Web site that it was considering a "nuclear option" on Michigan and Florida: Trying to ram through the DNC's rules committee at the May 31 hearing a plan to seat full delegations from Michigan and Florida.

Former Washington Post politics reporter Thomas B. Edsall's report said Clinton strategists were considering the idea of pushing supporters on the rules committee to make such a proposal, despite the considerable political backlash that would almost certainly follow.

Clinton aides dismissed the idea of a "secret plan" on Michigan and Florida. "We call daily for the delegates to be seated," said Clinton spokesman Phil Singer.

But Singer and top Clinton spokesman Howard Wolfson did not answer directly when asked if the campaign would ask its supporters on the rules committee to push for full seating. And Singer dismissed what most observers consider the most likely way to solve the dispute: a negotiated split of the delegates such as the plans proposed by Ferguson and the Group of Four, calling them "backroom deals" that would benefit Obama.
