One of the main birther arguments is that President Obama in not a “natural born” citizen because his father was not a citizen. This argument makes the claim that to be a natural born citizen; both parents have to be citizens. This claim is patently absurd. It was settled by the Supreme Court of the United States (SCOTUS) over 100 years ago in the case United States v. Wong Kim Ark (WKA). In this particular case, The Government of the United States (in particular, the custom service) attempted to exclude Mr. Wong Kim Ark from entry in the states after he returned from a trip to China. WKA was born in San Francisco.

As an American, I find many things in the history of the United States of America to be proud of. There are also a great many things that I find reprehensible, indefensible and simply wrong. The Chinese Exclusion Acts and the general policy towards minorities in the past two hundred years is a prime example.

One thing I do find admirable about this country are certain SCOTUS decisions. The WKA, like Brown v. The Board of Education, 50 years later being classic examples of correct, moral and right decisions in the face of entrenched opposition.

Anyway, WKA sued the United states claiming that he was a citizen by right of birth within the United States as per the 14th Amendment. The case wound its way to SCOTUS where in a 6 to 2 decision, WKA was indeed found to be a citizen by right of birth, and by the history of the term, a natural born citizen.

What is particularly interesting is the legal brief presented to argue the side of the Appellant, (the United States). In a typical legal brief, a lawyer will present his best and strongest argument last.

In the case of WKA, the Appellant’s last and supposedly best argument is a particularly loathsome, repellant, and vile racial attack.

I think any sane and moral American would be hard pressed indeed to defend that argument. Some will try, though and that is to our shame.

What is interesting is that two things jump out at you.

First is the fact that the counter argument to the WKA decision readily and freely conceded that the mere fact of birth as an American citizen was sufficient to qualify one for the office of president. When SCOTUS confirmed that WKA was indeed a U.S. citizen by way of birth, it also confirmed that he was also a natural born citizen.

Secondly, for those who say that the birther issue is not about race, simply replace the word “Chinese” with the word “Kenyan” in the above and you will have the entire birther argument in a nutshell.

There are good reason for smacking down birthers such as Orly Taitz. Much of the information that birthers want are none of their business as the court has decided.

This obvious includes Obama's "Law practice client list", as Captain Steve seemed as being an adequate request.

Let's see-the Joint Chiefs report to the Secy of Defense, right, and the military reports to them. So...whether you question the legitimacy of Obama or not, how can you question the legitimacy of the Secy of Defense, who was legally appointed by the previous President and serves at the discretion of whomever is President...Obama or Biden or Bush or McCain until removed.

You are correct in asserting that the Court found that Wong Kim Ark was a “citizen” without passing on the question of whether he was also a “natural-born citizen.” That’s because the latter issue was unnecessary to determine whether Wong Kim Ark had the right to enter the United States. The fact that he was a citizen by any mode meant that he had the right to re-enter the country.
