If CNN's Lou Dobbs drops the word "amnesty'' into most discussions of immigration, some of his critics say they aren't forgiving Dobbs.

An ad calling on CNN to drop Dobbs has been prepared by a group challengng the cable newsman's practices. The group claimed today that the ad would air on CNN next week, but the cable network said the group had its story wrong.

"Contrary to reports, CNN has not accepted these spots and they will not air on the network,'' a spokeswoman said this afternoon.

The cable news announcer's complaints about "broken borders'' have become a broken-record - "60 minutes of anti-immigrant hate'' -- according to the group whose prepared ad solicits signatures on a petition to drop Dobbs.

Media Matters said it has partnered with America's Voice, with the help of "thousands of grassroots activists'' who responded to fundraising for the anti-Dobbs ad campaign, to produce an ad it planned to run Oct. 21 and 22 during the cable network's heavily promoted Latino in America series.

This was only the latest move by a group that has mounted a full-scale campaign against CNN's self-styled "advocacy journalist.'' But the ad will not go on, CNN says.

"We assumed that when we purchased ad time on CNN, as long as the ad was accurate - which it was - it would run,'' Media Matters spokeswoman Jessica Levin said later today. "However, we have since learned that CNN has rejected the ad, proving yet again that the most trusted name in news isn't willing to critically examine one of its preeminent hosts.''

CNN, for its part, calls Dobbs "tough, relentless and independent.'' The anchor and managing editor of Lou Dobbs Tonight, CNN says, "has won nearly every major award for television journalism'' -- including an Emmy for Lifetime Achievement in 2005, a National Television Academy award in '04 and the George Foster Peabody Award for his coverage of the 1987 stock market crash.

Media Matters has complained about Dobbs' "history of anti-immigrant rhetoric'' and conflicts of interest, such as agreeing to speak at a fundraising rally for the anti-amnesty Federation for American Immigration Reform.

The "Drop Dobbs" campaign has drawn support from National Council of La Raza, the National Hispanic Media Coalition, the New Democrat Network and Southern Poverty Law Center. See their prepared ad above, their case below:

There is NO SUCH WORD AS 'ILLEGAL IMMIGRANT" in Blacks Law Dictionary, or In Merriam Websters Dictionary. Get Educated .

"Gov. Arnold Schwarzenegger said Wednesday that the claim by some conservative activists that illegal immigration is to blame for all of the state's fiscal problems is ignorant and bigoted."

Arturo E. Ocampo of Tracy has been a practicing attorney since 1985, In the 20-plus years I have spent studying, lecturing and litigating immigration issues, two things have always amazed me. The first is the amount and intensity of hate spewed against undocumented workers. The second is the amount of misinformation that is published about them.

On this second point, the quote from Mark Twain is illustrative. "A lie can travel halfway around the world while the truth is putting on its shoes." I suppose this may be true in part because misinformation, like a lie, requires no accuracy, validation or research; all of which are time-consuming practices.

The recent letters alleging that all undocumented workers are "criminals," and specifically Veronica Suarez, whose plight was written about in the Tracy Press recently, is a criminal are factually incorrect.

According to the facts (as stated in Sharon Franceschi’s Sept. 7 commentary) Saurez entered the U.S. on a valid visa, overstayed her visa when it expired, resulting in her unlawful immigration status. None of these acts, as stated by Franceschi, constitute a crime under federal or state law. Overstaying a valid visa under the Immigration and Naturalization Act is a civil violation of the law, not a criminal violation. Being in the U.S. in under undocumented status is not a criminal violation, but a civil violation of the INA.

The facts, as stated by Franceschi, do not indicate that Suarez has committed any crime. To call her a criminal is erroneous at best, and libelous at worst.

Furthermore, it is an Americanism that a person is innocent until proven guilty. So until Suarez (or any other undocumented person) is charged and found guilty of a crime, it would be inappropriate to call them "criminals."

It is important to note that there is a very large difference between civil and criminal violations of law. The distinction is so important that the law makes the erroneous allegation that one has committed a crime of slander or libel, (which means liability is automatic even without proof of damages). One who violates the civil law is no more a criminal than someone who has breached a contract or accidentally damaged another’s property.

It is true that entering the United States without inspection is a misdemeanor under the INA. The misdemeanor is completed once an individual’s entry is complete. Suarez, according to Franceschi, did not enter without inspection; she entered with a valid visa. According to U.S. Immigration and Citizenship Services statistics, about 40 percent of undocumented persons enter legally and overstay their visas (which, as stated above, is not a crime). Consequently, at least 40 percent of the undocumented population has committed no crime in regards to their immigration status.

Therefore, one cannot assume that a person has committed a crime simply because they are undocumented.

Franceschi is also in error in her allegation that getting married and having children while being undocumented in the U.S. is a violation of the law. It is not. Franceschi goes on to say that Suarez "apparently bought a house illegally." It is unlikely that Franceschi knows exactly how Suarez purchased her home. Consequently, any allegation of illegality is, at a minimum, irresponsible.

It is also important to note that the Immigration and Citizenship Services doesn’t consider all undocumented persons criminals. When the Immigration and Citizenship Services publishes information about its enforcement activities involving undocumented workers, it are always sure to make a distinction between "criminal" and noncriminal aliens.

Another myth is that the term "illegal aliens" is a term of art or is legal jargon. This term is not found anywhere in the INA or in Blacks Law Dictionary. The INA refers to undocumented persons as either an EWI (entered without inspection) or as someone who has overstayed their visa. "Illegal aliens" is a term invented by anti-immigrant groups designed to put undocumented persons in the worst possible light and to instill fear in Americans. It is intentionally designed to associate undocumented persons with criminality.

This xenophobic view that undocumented persons are "simply criminals" comes from the historical stereotype that the foreign-born, especially undocumented immigrants, are responsible for higher crime rates. This misconception has deep roots in American public opinion and popular myth. This myth, however, is not supported empirically and has repeatedly been refuted by scientific studies. Both contemporary and historical data, (including U.S. governmental studies) have shown that immigration is associated with lower crime rates.

The studies have uniformly shown that recent immigrants (including the undocumented) are less likely to be involved in violent crime, and that when there is an increase in immigration patterns, violent crime decreases. This has been shown to be true in large cities with heavy immigrant populations.

In the most recent of these studies, The Myth of Immigrant Criminality and the Paradox of Assimilation (2007), from the Immigrant Policy Institute, it was found that among men age 18 to 39 (who are the vast majority of inmates in federal and state prisons and local jails), immigrants were five times less likely to be incarcerated than the native-born in 2000.

During the Proposition 187 debate, then-Gov. Pete Wilson published statistics that stated that
12 percent to 15 percent of the state prison population had Immigration and Citizenship Services holds or potential holds. The Department of Corrections analyst who compiled these numbers said Immigration and Citizenship Services holds are placed on inmates who were born outside of the U.S. (therefore 12 percent to 15 percent of the prison population was immigrants). The immigrant population at the time in California hovered at about 25 percent, showing immigrants were much less likely to be incarcerated than the native born in California.

In short, the data shows you are much safer if your neighbor is an immigrant.

Franceschi owes Suarez an apology. I am also surprised that the Tracy Press allowed a commentary to run without checking the facts. Although commentaries are designed to allow for the expression of differing opinions, the First Amendment is not as generous with misstatements of facts — especially when the facts can be libelous.

For the immigration debate to be a healthy one, we should strive for a debate based on facts, not myth or tired stereotypes. We should also not let our position on this topic strip us of one of the great qualities we possess as people — the ability to be compassionate.

That explains his misleading use of statistics. Also, the vast majority of illegals are not simply sitting around with an expired visa. They are stealing identities, driving unlicensed and without insurance, illegally obtaining health care and a host of criminal activities. Sorry but we either place no limits on immigration or we assert our right to protect our borders. The US is by far the most generous country in the world and sends billions overseas so your lack of compassion argument is as empty as the rest of your post. Some would like to immigration levels increased to the point where third world socialists and criminals become the voting majority in this country. It is not a race issue, it is a desire to keep the cultures of corruption, crime and sponging off the government from taking over in the US. I hear Dobbs is moving to Faux anyway. He'll feel much more welcome there, but at some point he will realize that a big paycheck isn't all that great if you have to hang around with a bunch of close-minded idiots all the time.

I can't say that I'm shocked by these boneheaded Republicans (Dobbs) and their demonizing of Spanish-speaking immigrants. This tactic of blatant, shameless racists calling OTHER people and groups racist because they believe that someone other than rich, straight, white men should get ahead just makes the GOPer's look worse than they already do.


I want the GOPer base to lap it all up with their leadership and their media arms (Dobbs and Faux News etc) hatred of minorities here. Playing to what's left of the GOPer base will only alienate swing voters and pound a few more nails into the GOP's Hispanic coffin.

Those of you that are so hot to have ILLEGAL IMMIGRANTS made citizens thereby allowing millions more immigrants to be brought into the US, should love it when they take over your neighborhood and have 6 families all living in a single house all with cars and children. Playing loud music all the time, picking on every other kid in the neighborhood that isn't like them. Setting up food stands in their front yard, raising a rooster outside your bedroom window that crows everytime it sees a light, overcrowding your schools, having to have a special ciriculum for Non-English speakers, give them free health care and every other service available.

I actually had one urinate in my front yard. Our son was targeted because he was different. And, all the garages in the neighborhood become apartments.
I'm not picking on them, immigration should be fair and not just for people that break the rules, the LAW, and jump to the front of the line.

Since they don't care about our rules for immigration, they don't really care about other laws either. Driving with a license, stealing identities, building codes, and any other little old law that they can avoid, like paying sales tax. They shop at open air swap meets where sales taxes aren't collected. They work under the table, because employers don't want to pay workman's comp. insurance, and they don't want to pay income taxes. I worked construction for 25 years and illegals work for cash, or they work for less, thereby cutting wages down and lowering the standard of living.

They aren't just farm workers, they do every type of construction job. It takes jobs away from Americans.


E-Verify should be on the national agenda to countermand any illegal alien infiltration into the working environment. Whatever needs to done should take priority to remove the unauthorized labor in our jobless nation. More funding, more modifications until the illegal immigrant fraudulent use of documentation becomes a thing of the past. Using whatever technical programming that is available, to make it's operation inadvisable? Any database including state criminal, FBI, Social Security, Homeland Security, and any other means possible. Ultimately the final version would contribute photo verification, national ID system with biometric data which has been recommended by the Brooking's Institute and Duke University MIT. Supposedly small employers who don't operate computers should have common access in such locations as Post Offices or other approachable government building to identify the workers they are hiring.

There should be no excuse to not install a nationwide mandatory system of worker identification. My suggestion is that--ALL-I-9's should be copied and a duplicates sent to a Homeland Security Clearing House? Creating such an office would be a simple affair, if our state and federal government would be more beneficial to the working American male and female. If our government is sincere in securing our borders, and introducing new immigration enforcement tools, then E-Verify will become the final deterrent and not be weakened by Sen Harry Reid and his administration. I have made a point of speaking to a few business human resources departments, and found most are enthusiastic about the use of Verify. Only 1 of the 6 companies that I investigated determined some false negatives" and "false positives. But they always have a backup system of contacting the Social Security agency nearest to them, until the irregularities are resolved.

All that remains is citizens and legal residents to stop the Obama people from throwing a wrench in the cogs and stopping any technological advancement with E-Verify. E-Verify can be used on a universal level in checking bogus drivers license applications, auto insurance, home purchase, health care and other personal data. It would certainly alleviate the kidnapping of social service programs by the 20 to 30 illegal immigrants in America. It would displace foreign nationals so down-trodden legal single mums with children, homeless vets, senior citizens and even students could get employment. It all depends on all of us to contact our Representative in Washington at 202-224-3121. Tell them you don't want half measures by full permanent implementation? NO MORE DRAGGING THEIR FEET? Tell them your remember them on next election day. YOU ALSO WANT AN END TO ANOTHER AMNESTY.

Don't let them distract you, but repeat your demands without hesitation to these open border jerks. Invest a little time and check what your politicians are doing to our immigration enforcement safeguard at NUMBERSUSA. Read about the consequences of future OVERPOPULATION at WEBCAPS and our collapsing infrastructure, that has been ignored for decades nationwide. Last read factual information at JUDICIAL WATCH that discloses the lawmakers, that are running the country for themselves, friends and business associates. ITS ALL FREE. Read that some of the White House Czars are not true Democrats, but are shadowed by their past Liberal Marxist backgrounds.

Are you too stupid to discern between legal and illegal immigration? Do you care to make a guess as to how many surgeons are sneaking across our borders or overstaying their visas?

BTW, DeBakey was born in the US and therefore is not an immigrant. If someone with his education were to apply for citizenship I would hope he received priority over some illiterate whose only claim to the US was he could sneak across the border.

I sympathize with the point you are trying to make, but you fail with the example of Michael E. DeBakey. DeBakey was born in the United States, in Lake Charles, Louisiana. He was a natural born citizen of the United States. His parents were immigrants, not him. And, furthermore, there is no indication that either of his parents immigrated to the United States illegally.

If Lou Dobbs hated all foreigners, as you appear to claim, then your point would have been valid. What little I have seen on CNN, Dobbs is obsessed only with the illegal immigration and ‘amnesty’ issues.

There were no quotas or restrictions when DeBakey's parents immigrated. If the laws in place today were in effect then, they would be "illegal".

If I understand you correctly, you use “undocumented” to refer to those who have entered the country illegally and are not naturalized. Such people are not “citizens” regardless of how much you want them to be. They can’t get social security numbers or lawfully file a tax return. If they file tax returns, they have to use bogus SSNs, and that is a form of tax fraud. Thus, regardless of how much these people contribute to the economy and society, we cannot call them citizens, and certainly not law abiding citizens.

Although I agree with you that the United States needs to quit being hypocritical when it comes to the question of illegal immigration, I can’t agree with you that it is proper to lie or whitewash the facts to gain public favor. You do a disservice to your own cause when you do.


Wanting laws on the books to be enforced is now "racist"

The last time I checked, this was still a free country. Freedom of speech is still a right ALL Americans have. So speak your hearts and minds.
