Arizona Gov. Jan Brewer (R) says she is filing an expedited appeal to today's court ruling barring certain provisions of Senate Bill 1070, saying she's willing to take the fight over state's controversial illegal immigration law to the Supreme Court if necessary.
"This fight is far from over. In fact, it is just the beginning, and at the end of what is certain to be a long legal struggle, Arizona will prevail in its right to protect our citizens," she said in a statement.
Randy Pullen, chair of the Arizona Republican Party, predicted the case would ultimately end up at the Supreme Corut.
"The federal government's argument that SB 1070 would have placed and undue burden on them is as absurd as it is a complete dismissal of the tremendous burden placed on Arizona by the federal government not doing its job," he said.

I am deeply grateful for the overwhelming support we have received from across our nation in our efforts to defend against the failures of the federal government.
I have consulted with my legal counsel about our next steps. We will take a close look at every single element Judge Bolton removed from the law, and we will soon file an expedited appeal at the United States Court of Appeals for the 9th Circuit.
For anyone willing to see it -- the crisis is as clear as is the federal government's failure to address it.
The judge herself noted that the stash houses where smugglers hide immigrants from Mexico before bringing them into the country's interior have become a fixture on the news in Arizona and that, 'You can barely go a day without a location being found in Phoenix where there are numerous people being harbored.
When I signed the bill on April 23rd, I said, SB 1070 - represents another tool for our state to use as we work to address a crisis we did not create and the federal government has actively refused to fix. The law protects all of us, every Arizona citizen and everyone here in our state lawfully. And, it does so while ensuring that the constitutional rights of ALL in Arizona are undiminished - holding fast to the diversity that has made Arizona so great.
I will battle all the way to the Supreme Court, if necessary, for the right to protect the citizens of Arizona. Meanwhile, I also know we still have work to do in confronting the fear-mongers, those dealing in hate and lies and economic boycotts that seek to do Arizona harm.
We have already made some progress in waking up Washington. But the question still remains: will Washington do its job, and put an end to the daily operations of smugglers in our nation, or will the delays and sidesteps continue? I believe that the defenders of the rule of law will ultimately succeed with us in our demand for action."

Immigration law is one of the few expressly enumerated powers of the Federal Government to regulate. In almost any other context it would be such a no brainer that the law would not have been passed or there would be an injunction filed immediately upon its passing.
Public perception (thanks to the Right Wing Noise Machine) is a much bigger problem. Everyone knows that the nations' immigration policy needs to be addressed (big secret* - the nation's biggest corporations need immigration to stay the way it is, they can keep paying below minimum wages and get needed labor) - and the only realistic choice is amnesty. Deport Everyone! sounds like a great Republican rallying cry, but how do you deport 10s of millions of people? Plus its just wrong.
Buuut, there is a perception on amnesty side and kick them out side that something needs to be done and though it is sure to lose in Court, I am concerned that many many sheep will think "dang right the Federal Government hasn't done anything". So, they should at least be ready to put out an alternative plan as they pursue the lawsuit.

Shorter Republican Response: Prosecute lawbreakers!...unless the lawbreaker is a big business owner who knowingly hires undocumented workers in order to get cheap labor, avoid payment of benefits, and ensure that workers won't complain to state or federal officials about conditions in the workplace.
Republicans are screaming about illegal immigration (see Arizona) and yet it's the Republicans in the Senate (Lindsey Graham, John McCain etc) who are the ones who are actually blocking immigration reform debate from going forward in congress.
There's a reason why the Repugs in congress would rather demagogue on the border issue rather than actually take steps to fix the problem - Big Business.
Big Business is making a killing with the cheap labor that illegals are providing them with and almost every single Republican in the Senate is in the back pocket of big business (and Big Oil and Wall Street). The way to fix the illegal immigration problem is to crack down hard on these Big Business corps who are hiring illegals. No jobs = no incentive for illegals to cross the border.
But that's the problem, the Repugs WILL NOT crack down on their Big Business pals who provide them with mega millions in campaign donations....so they spend their time whining about the "evil brown people" crossing the border illegally while also working to make sure that immigration never comes up as an open topic for debate in the Senate.

Two Top Advisers For Arizona Republican Governor Jan Brewer Lobbied For Prison Giant CCA
Bigotry may not be the only motive behind Republican Arizona Governor Jan Brewer's rabidly xenophobic new immigration law. Another factor may be that timeless Republican standard: greed. Zaid Jilani of Think Progress explains:
Yet a new investigation by local Arizona TV news station CBS 5 finds that the Brewer administration may have ulterior motives for its strong support of the new law. The station has found that "two of Brewer’s top advisers have connections" to private prison giant Corrections Corporation of America (CCA).
"Paul Senseman, Brewer’s deputy chief of staff, is a former lobbyist for CCA. His wife continues to lobby for the company. Meanwhile Chuck Coughlin, who leads her re-election campaign, chaired her transition into the governorship, and is one of the governor’s policy advisors, is president of HighGround Public Affairs Consultants, which lobbies for CCA.
The private prison industry houses illegal immigrant detainees for the federal government. Those companies could gain contracts with state and local agencies to house illegal immigrants arrested for state violations.
Corrections Corporation of America, or CCA, holds the federal contract to house detainees in Arizona. The company bills $11 million per month."

The fact is that the federal government has failed miserably at enforcing the current immigration laws.

I'd guess that if you asked everybody in Arizona, the overwhelming majority (of all political stripes) would agree they'd prefer NOT to have their own immigration statute, but would rather have the Feds secure the border and manage migrant labor through visas and work permits.

In the absence of the Federal government enforcing existing immigration laws, quite a number of states (not just AZ) are passing their own. According to the National Conference of State Legislatures, an astounding 44 of the 46 state legislatures that were in regular session in 2010 passed laws dealing with immigration.

The clowns can shriek about racism and profiling all they want (which is not the basis for the Administration's lawsuit, BTW) but the states are going to continue to pick up the Feds' slack.

The Eve of Arizona's SB1070: The Eve of Destruction?
On the eve of implementation of SB1070, Arizona’s anti-illegal immigration law, United States District Court Judge Susan Bolton, a Clinton appointee, issued her decision on the federal government’s suit seeking an injunction against or the voiding of SB1070.
In a nutshell, illegal aliens won, the American people lost, although we haven’t lost everything. The judge gutted the principal features of the law but allowed some provisions to stand.
Also, there will be appeals, first to Bolton to re-consider her decision and then probably to the Ninth Circuit Court of Appeals which is the most liberal circuit court in the country but which has sided with Arizona on similar issues in the past.
There were high hopes that Judge Bolton would find for Arizona since she had voiced skepticism as to whether SB1070 actually does pre-empt federal immigration law and whether the feds should be trying to overturn Arizona’s right to be “inhospitable” to illegal aliens but politics eventually prevailed.
Okay, so what’s out and what’s still in? . . .

Once again, you prove that you know nothing about this or any other issue. Well, in a way it's understandabe, you don't want to overwork that brain cell.
We don't want to put illegals in jail, unless they commit a crime, a crime in addition to the crime of being here illegally, we want them to be deported. We want them to stop stealing resources that are paid for by legal citizens that pay taxes.
Immigration reform is just amnesty. If they pay a fine, they can pay the fine with money they will get from their first tax return in the form of Earned Income Credit. In fact, the Earned Income Credit refund that they would receive would be MORE THAN THE FINE.
Give amnesty to millions of illegals, and you have a real invasion and you won't be able to "Seal the border."

If you want to ignore the law against illegal immigration, just because millions have broken the law and the government hasn't done it's job and caught them all, how about we ignore the the healthcare bill and just let people do what they want to? After all, to punish millions is wrong according to you. How about we forgive all those that don't want to pay taxes, because it is just mean and nasty to enforce that law. God only asks for 10%; what right does the government have to steal 50%.
And rob, why have the IRS enforce the healthcare laws against 150 million American citizens that don't want it? I believe that is a larger number than the 30-40 million illegals in America.

So the AZ Reps design a bill that they know will struck down in the courts. It is patently unconstitutional. Anyone who has read the constitutions understands this. So how about fiscal conservatism? Knowing that this bill will not pass constitutional muster, they are doing for political gain. Not minding the hundreds of thousands of dollars for court costs. Very conservative indeed. Also, maybe instead of asking for a fence (worst idea ever) they should have asked for the funds for more patrols. Nope, Bush gave them a fence. How is the that money doing now?
Look into the history of running an anti-immigration campaign and see how that worked out for the political candidates. Way to alienate a huge chunk of voters.

Roger Morris, I am Not wild about the law. In fact I am afraid that if this law is upheld it will give some overzealous police a "carte blanche" to stop just about anybody on the street including American citizens and immigrants who came to this country legally. I have seen what overzealous and untrained police have done questioning railfans taking pictures of trains. Some of those police, not all, have even claimed that the Homeland Security Act has made it illegal to take picture of trains and anyone with a camera is a 'suspicious" person. The interpretation of the Constitution bysome of those police has been
unbelievable. No where in the Homeland Security Act does it make photography illegal. That is why this Law is bad. But if the Obama Administration and other Presidents before him, both Democratic and Republican, had been enforcing existing laws and protecting the borders, States such as Arizona would never have even thought of passing such legislation. Many States, especially along the border, are being overrun by illegals and the Federal Government is doing Nothing about it. You even get the impression the President Obama and the Justice Department is even condoning this illegal activity. It is time for President Obama and the Federal Government to start enforcing the law. Barrack Obama was elected President of the United States, not the Preside not of Mexico.

One difference is Arizona assesses both a personal and corporate income tax, which Texas does not."
