The U.S. Senate has voted to confirm Elena Kagan as the nation's third female justice on the United States Supreme Court. The final vote was 63-37, with five Republicans supporting the nomination and one Democrat voting no.
President Obama's second nominee to a Supreme Court seat, Kagan will replace the retiring John Paul Stevens, the high court's longest-serving current member. The 63 votes in favor of confirmation is the third-lowest total in more than a half century.
Kagan, the 112th justice in the Court's history, will be just the fourth woman ever to serve when seated this fall. She watched the vote with her Justice Department colleagues in the Solicitor General's conference room.
Obama will offer congratulatory remarks later from Chicago, the White House says.
Jim Oliphant has a full report on the news here.

Congrats to Elena Kagan! No one should have to be subjected to months and months worth of racist and misogynist rantings from Jefferson Beauregard Sessions III.

At least there are some Republicans who use their brains instead of voting the party line. Now if we can just get the rest of them to act like grown-ups we may get out of the financial mess we're in.

Swamp Troll,
Yeah, she's (Kagan) almost as ugly as you are...except for one thing: She's a Supreme Court justice now and you're still just a lowly mouth-breathing wingnutter, who despite already being banned from other blogs for your sock-puppetry and spamming, somehow (multiple ip addresses) has still managed to stick around here for a long time.

It’s obvious (to anyone who thought about it) that Kagan was nominated to the Supreme Court to preserve Obama’s expansion of the federal government to suit the progressive agendum. FDR did the same thing, and then threatened the court to keep it in line; and it worked.
.
If Republicans had used their brains, then every last one of them would have voted against her confirmation. The problem is that progressivism has infested and infected the Republicans, so that they, too, are happy with the big government model. So now we have another vapid ideologue on the Court.
.
And, BTW, Congress can blow hot and cold as they like, and they are not going to solve either the financial crisis or the related problems with the economy. The problem was caused by the private sector, and it must be solved by the private sector. Indeed, if Congress decides to pile up a larger regulatory regime for banks and capital investors, the Capital Strike we are now suffering through may go on indefinitely.

Johnny W. Bircher,
It’s obvious (to anyone who thought about it) that Roberts and Alito were nominated to the Supreme Court to preserve Bush’s expansion of multi billion dollar corporations taking over the duties of the federal gov't to suit the wingnut agendum and line their own pockets with campaign cash. Saint Ronnie Raygun did the same thing.
You see, anyone can play the internet lawyer game, Sparky.

What Rob Said...............
Rob,
Thanks for saving me alot of time, because I don't have time to respond to idiots like Libtard, John D, Terry, John W and the rest of the "paid" bloggers on the Swamp. Again, thanks for doing it. Oh, congrats to Elena........give them hell and watch out for Clarence; keep him away from your Coke cans.

Thank God, another sane mind has been added to the The Supreme Court, of political hacks!! With Roberts and Alito giving away our " free speech ", to the highest bidder, corporate interests, both, domestic and foreign, we need some sanity back on the bench at our Supreme Court. Hopefully, President Obama will have another slot or two, to fill. than we can have a Supreme Court, that will truly honor " State's Rights ", particularly when it is related to a given state's electoral processes!!
SUPPOR OUR TROOPS, BRING THEM HOME, ALIVE AND WHOLE. NOW.

She's just another east coast elitist. As for the Republicans that voted for her, they should
be voted out of office as the earliest possible moment. We
do not need anymore idealists
sitting on the nations highest
court. They should keep their
opinions to themselves and just
apply the law according to the Constitution.

@Paul
You don't want "idealists" on the Supreme Court. You jwant them to "just apply the law acccording to the Constitution."
Some might call that sort of an idealistic objective, Paul. No?
Besides, let's get real here. A member of the Court may not interpret the Constitution in the same way a deep thinking legal scholar like you might. That does not mean they are not faithfully applying the law; it only means you see it differently.
We live in a pluralistic society, where not everyone has to agree on everything. Not even with you; not even if you stamp your feet a lot. Grow up.
-------------------
We do agree, though, that the Republicans who voted for Kagan should be voted out. Where we part company is I see that as the start of the process, not the end.

So, Biff, how is it that I was playing "internet lawyer" by making the comments that it made? I didn't invoke the law, and neither did you. Making political comments isn't lawyering. This, again, shows how totally clueless you are.

I think the President has been disappointed in some of his appointments, ones made on recommendations, people he didn't know personally.
He knew this new Justice personally.
Also, she, like him, were somehow switched to the sidetrack rather than the "tenure track" at the U of Chicago.
For not having the "right" politics.....
Ironic, isn't it? Two U of C professors who were not offered tenure.
On is now President of the US.
The other is on the Supreme Court.
One of life's little ironies....
