Kagan confirmed as Supreme Court justice

The U.S. Senate has voted to confirm Elena Kagan as the nation's third female justice on the United States Supreme Court. The final vote was 63-37, with five Republicans supporting the nomination and one Democrat voting no.

President Obama's second nominee to a Supreme Court seat, Kagan will replace the retiring John Paul Stevens, the high court's longest-serving current member. The 63 votes in favor of confirmation is the third-lowest total in more than a half century.

Kagan, the 112th justice in the Court's history, will be just the fourth woman ever to serve when seated this fall. She watched the vote with her Justice Department colleagues in the Solicitor General's conference room.

Obama will offer congratulatory remarks later from Chicago, the White House says.
